Send them a (large) invoice for use of your image.
You own the copyright, regardless of where you've posted it before (unless that was facebook, in which case it gets complicated).
I'd have a go for a DMCA takedown notice and SWAT their head office* just for giggles.

I remember you talking about this at the time. Did anything ever come of it? I'm not sure as the subject has any grounds to complain (I could be wrong here?), but for the photographer that's simply theft.

A few years ago Toyota nicked an image of mine from Flickr for a website promoting a new 4x4.
Only reason I found out was that they hotlinked the image back to my Flickr page, so I wondered why it suddenly had 2000+ views!
After a complaint I received a nice letter of apology and a cheque for $1000 from the advertising agency who'd done the website. To say I was happy with that would be an understatement!
They only paid you $1000 unprompted because they are well aware it's worth far more than that.
The value of images is very low and getting lower. Check what you would pay on a stock photo site to see. This sort of thing is common and probably will be more common. A lot of people think anything on the internet is free.
Worth looking at a stock photo site to see the likely price, then letting the offender know they have "accidentally" used your image. You are more likely to get an offer of payment that way.

Considering I'm not a pro photographer, and it was literally a holiday snap, I was happy with the windfall.

so what is the gist of image rights when its you persoanlly? I had a photo taken whilst i was abroad in a hot dusty place. I asked the photgrapher for a copy of the image so i could trot out the "during the war" story to the grandkids in 30 years time. i never got a response, from them or getty do i have a right to it?
No you don't have any right to the image or copyright. If you're outdoors it's fairly safe to assume there is no 'expectation of privacy' so anyone can take photos and do with them what they like.
As least that's in the UK. I guess it's potentially different in whatever country you were in.

AFAIK - As an image subject, you only have the right for an image of you not to be used commercially - ie, not linking you to a specific product or company. That requires Model Release to be in place and the onus is on the publisher (either the company themselves or the ad agency) to ensure that is done. So, in Footflaps case, the guy in the image could have sued of his own volition.
As Superficial says, you don't have any right to a copy of that image by default, even if you're pictured.
Well, a mate who has been vegan his whole adult life found himself appearing in a McDonald's hoarding over in NZ a few years ago. Photo had been taken at a MTB race and was on Flickr.
Contacted local press, story made national news, McDs took the hoarding down despite there being no legal obligation, having outsourced the hoarding to a design co.
Outside anyone can take a picture and publish it so long as a it's not defamatory about you as a person. b used to advertise or endorse any product. For example, having dinner in a restaurant does not grant them the right to use your image in an advert. As this happens now and then i'd like to know how that image was removed from a facebook page, and copied into a folder of 'images we have rights to use'.
