I think I have a handle on this but thought it worth checking with the STW Hive who with all the "it could have been a child's face" clearly have child safety at the forefront of their minds....

LMTTM Jnr is over 135cm tall and heavier than 36kg but is only 8.

Using a child car seat or booster seat

Children must normally use a child car seat until they’re 12 years old or 135 centimetres tall, whichever comes first.

Children over 12 or more than 135cm tall must wear a seat belt.

You can choose a child car seat based on your child’s height or weight.

According to the above advice from gov.uk he doesn't need a car seat on the grounds of height. Most group 3 car seats only go up to 36kg so he is too heavy on that front.

So are we car seat free for child no. 1

Well, yes, according to the guidance you've posted.

'Normally' - your child is abnormal, in a nice way.

'You can choose' - fill your boots. Not literally, unless he's annoying. 🙂

yeah our number 2 is now 136cm so no legal requirement for a seat, she still uses one in the van as shes more comfortable but not in the car

Yes, you're not required to use a car seat or booster. You can use one beyond if you prefer. The 36kg thing is just from the group 3 definition - they're retained by a regular seat belt which is rated for adults, the booster is just there to hold them in a more comfortable position.
