So a speeding ticket turned up in yesterday's post, it was issued on May 1st for an incident that apparently took place on the 28th Feb.
It's my understanding that they should be issued within 14 days of the offence. Would you try & fight it? If so how?
Or just suck it up & move on with life.
Was it you?
Did it go somewhere else in the meantime? Is the V5 in a finance/hire companies name?
Have just been through similar, though it looked as though the first attempt at getting the driver info went AWOL in the post. On the advice of someone in the trade I simply phoned up and asked for proof of postage and lo and behold a copy of the original letter arrived in 1st class post... so I'm going on a course.
Assuming you've just had the form asking for driver info, I'd give them a tinkle and state the scenario. If they aren't abiding by their own rules they may tear it up and through it in the bin with little resistance.
ETA: exact wording of the advice I received, "If they have proof of postage to the right person at the right address inside 14 days [it's valid], if they've not complied they'll have to throw it in the bin" But again, scenario was first letter went AWOL. So may be different.
drive slower?
Your car or a lease/company car?
the notice has to go to the registered keeper within 14 days. If your not the RK then pretty much tough. If you are the RK and your name and address are absolutely correct on your v5 then the notice hasn’t been served correctly. There is further advice and a template letter on the RAC website to assist you if the above applies..
oh, and drive slower...;-)
Thanks all - it's our car, it's a possibility they might've had difficulty in tracking us down as we moved last year.
& yes - will drive slower in the future, however as it's my 2nd speeding offence in 25 years of driving I don't think I'm doing too badly!
Do you have a significant other? Do the pair of you have a foreign handyman who was out of the country at the time? Could you blame them? What could possibly go wrong?
(The advice above seems sound, but IANAL)
they might’ve had difficulty in tracking us down as we moved last year.
The letter should have been addressed to the registered keeper as entered on the V5. The V5 is up to date though, yeah?
If you've moved, did you inform DVLA and receive a new driving licence? If so then you should have also updated the V5 - see here https://www.gov.uk/tell-dvla-changed-address . So as above, if the original NOIP went to your old address within the 14 days then they've abided by the process.
If your V5 is really months out of date then pay, update, keep quiet and hope no one notices.
Potentially £1k fine [ref: https://www.gov.uk/change-name-address-v5c ] and invalidates insurance assuming you claim registered keeper at your current address.
Pay up surely you recall signing the Magna Carta which established the principle that everyone is subject to the law, even the king.....
Oh blimey...
Go check your driving license and v5 have the correct address. It’s an offence in itself not to update, and Christ only knows what else might be hiding from you. It’s not unheard of for people to rack up 12 or more points and not know because they haven’t done the paperwork.. DVLA website should give you an indication of whether your license has been revoked.
