What is the general take on this? If say for example a photo is posted on a public (no request to join etc) Facebook page and then shared by a 3rd party outside of Facebook, does the original poster have any claim to that photo if no watermarks / copyright type stuff is evident on the original photo, and can they therefore complain about further public sharing?

Best quick summary I found, you are still the creator of the image and own it but you have licensed it to be shared etc.

as long as there was a credit/link to Instagram account etc I'd have no problem with it for pvt use. commercial is another matter & I've contacted companies who have used my stuff without asking & invoiced/ asked them to remove it.

If you didn’t take it or buy a licence you don’t have any rights to post it elsewhere. Just because it’s on the internet doesn’t make it public property. Replace ‘photo’ with Hollywood movie. Would you expect to share that with no consequences?

supernova - is that true in all cases? STW used a photo of mine posted on here on their facebook page without asking and I think with no attribution or linking back to the original source. I assume legally 'cos of the terms and conditions on here but if someone then copies it from facebook who holds the rights then or is it free game?

There was no credit etc on the original photo, it was part of a montage from CXWC, the comment was "Photos aren't free"

First part yes, 2nd part, haven't got a clue as there doesn't seem to be any option to purchase it
