As I feared....

A few days after I bought an Exposure light, Evans went into administration. Despite this, they assured me that the light would be in stock, even showing a delivery date (today). I have this by email confirmation.

Today comes  - guess what? They cannot fulfill the order.

Nor will they refund me (as they have changed hands and obviously dipping into administration is in their favour here), in fact, they have offered me nothing.

Hoping I can chargeback on the credit card - although to complicate matters I bought an evoucher to make payment. The voucher company are about as helpful as Evans. Sorry you used it...tough luck. Over to Evans.

I did pay about 50p on my mastercard to Evans for the residual value relating to that purchase.

Legal types of singletrack....help!

Voucher element aside, youll be a creditor to the "old" Evans and at the back of the queue when it comes to getting money back.

But is my contract with them, the voucher company, or can I chargeback the whole amount on the mastercard?

Not advice to give in terms of getting your dosh..

There is a provision for a chargeback from your bank/CC company where a company you've placed an order with goes bust (this is separate from Section 75). Check the MSE site. (Probably the voucher complicates things but not sure how - maybe try ringing your CC company?)

I looked into this myself as I also had an order for an Exposure light outstanding, fortunately it was in stock and did actually turn up after a week!

That's bonkers, they still sell Exposure lights. It's nothing to do with you that they've changed hands. Fulfill the order!

I assume you've bought the voucher with the CC? Might be that that knackers you, as the voucher co has given you the product they promised, a voucher. You'd probably get the amount you paid to Evans on the CC back though

Didnt they agree to honour old vouchers until sometime in january, in which case the voucher my still be valid if you try and place the order again?

If you've paid for any part of it with the credit card - even 50p - you're insured by the card issuer for the full amount and should be able to claim it back against them.

Dunno if the receivership thing complicates that or anything, but if I were you I'd be on the phone to Mastercard.

I was quite prepared to write off the residual 53p!

interestingly, the voucher company are still selling the vouchers, with a note that anything bought in october or before needs to be used before the end of the year.

I bought the voucher on Amex.

I've talked to the voucher company, and also initiated a chargeback through Amex as a fall back position if the voucher company won't pass a credit to my account.

There was a story of a lady doing that with House of Fraser, when confronted by police she produced her receipt showing she had paid for it, so nothing they could do!

Would take a bit of a brass neck, could result in confrontation with the staff which personally I'd be too spineless for...

If they don't have the light, then Shirley the amount should go back on the voucher as technically it hasnt been used ? To then be used by the end of the year ?

I can understand why they wouldnt refund the voucher back to your CC as you have bought a voucher so that bit has been fulfilled. The fact you cant spend that on what you want isnt their problem.

I assume you used a voucher as it had some sort of "discount" attached to it ? Groupon type thing ? Could you sell the voucher to someone at a knock down price ?

Looking at Evans T & C's it looks like they take your money whether its in stock or not. I hate that setup

1, ring credit card company, see what they can do

2, check if gift voucher still valid, if so spend it, asap, even if you don't need anything buy a poular item that you can sell on ebay for 80% value,

3, never hold onto gift vouchers or credit note when their is talk of administation, as soon as the first notice came out late summer, i spent my credit note..

4, people talk about going into the store and taking the item, depending on your job this is an extremely bad idea, guilty or not a criminal record / being charged for theft is a simple means of getting rid of staff..

ps. If you topcashback or quidco, do not save for a rainy day, take out money frequently.. (has been talk of quidco going bump all year) they are paying these £2.50 bonuses and they are not sustainable long term the P&L/BS is shocking year on year..

OP has paid for a product, not a specific product in a particular shop. S/he is not entitled to walk into a shop and just take one. House of Fraser lady was not right in law (but was certainly morally right) but presumably the shop CBF getting more bad publicity and legal problems for the sake of a frigging sofa.

ajaj is right sadly, whilst it appears to the consumer to be the same company your dealing with, it's not. Same premises, staff and stock, and wholly disingenuous. But a different company.

The staff could be helpful when you go in rather than showing no F***&g interest what so ever which might result in sales which in turn could make their shop profitable and one that may remain open rather than being on the list for closure.

I went into the Havant store, partially to be supportive, early on a Monday morning 2 weeks ago and asked if I could use their sit bone measuring tool (I'd rung up prior to going there to make sure they had one) ... to be told by the member of staff .... they do have one but it's only for Bontrager saddles and they don't have any of those in stock.

I mean seriously what a complete dickweed ... a 143mm measurement isn't transferable from one brand of saddle to another ... derrrr .... I went back to look at the saddles in case he was just stupid and didn't realise that and whilst it wasn't a huge selection they did have some Bontrager ones in.

My response was to walk out of the shop, drive somewhere else and and draw up my Xmas list there instead which comprises of a £1300 bike (funded by everyone giving me money for B'day and Xmas and me e-baying some other things as well) along with all the associated bits that go with a new bike (frame bag, saddle bag, lights, mudguards etc. etc.

Personally I lost interest in being nice to the staff and trying to be supportive when they couldn't be F...**g bothered to help you.

Update!

Evans did start showing as having new Exposure lights in stock. They would let me spend my voucher...but not on what I had originally ordered as they couldn't get that model.

I was left with the choice of buying the light elsewhere, and choosing £180 of stuff from Evans I didn't really need, or stumping up an additional £60 to get the next light up. which I ended up doing.

Just to rub a little salt in - the original light had "10% off all lights" due to an offer code (which is why I went for it). They refused to honour this to the new order. (so they charged me the difference between the discounted original purchase and the shop price of the new light.

Thoroughly disappointed in the whole episode and won't be using them again, unless it's a real emergency.

Glad it worked out for you. Nothing stopping you going back in and  asking for refund on the new light, as it's not what you wanted. Then buying the one you wanted some where else. You're covered by the consumer rights act.

Seriously though - I know a couple of hundred quid probably isn't too big a sum to them or on their list of priorities right now, but it is to me. Especially at this time of year!

And despite being a new company - you'd think they would want to keep any goodwill from the existing customer base.
