Myself and the family were out for an explore along the route of an old railway branch line and various farm tracks, etc on Saturday. Jnr is 13 and she really enjoyed the 'adventure'. We fully observed Countryside Code and NFU Guidelines.
However, as we exited a fairly visible path running parallel with a wee burn (stream) a lady walking along the rural road shouted that she wanted a word... This lady advised that we should not really be following the path as "It's private land and there could be shooting down there." She also advised me that the estate which apparently is the landowner "Has dispensation from land access laws". I thanked her for her kind guidance and proceeded upon our way.
I understand dispensations around property, gardens, etc, but this path is a good 1/2 mile from the main castle where the land-owner resides.
So...where would an interested party find whether the entire estate has dispensation from Land Access? FYI, it is Cluny Estate beside Monymusk in NE Scotland. Most access gates into the area around the main castle are closed, with multiple signs advising of CCTV. However, the suggestion of the entire estate not having to comply was interesting...I smell BS but interested to know whether there any fact at play.

You have to remember that a lot of people (75%+ I reckon) will just accept her 'advice' at face value and turn around.
From her point of view that reduces the amount of traffic she doesn't like by 75%. Job jobbed.
This is happening a lot right now.
There is one exclusion that many folk are unaware of: if the estate charged for access prior to 2003 then the LR(S)A allows them to continue doing so and to restrict access accordingly. They could, for instance, allow walkers but not cyclists.
AFAIK Cluny Estate does not fall into this category, though they do make a big thing about the seclusion offered if you are into weddings, corporate events, film location etc.
Council Access Officer is your best point of contact.
Thanks folks. Scotroutes, the castle is certain 'protected' more than likely Fort Knox due to closed gates and multiple signs warning of CCTV.
It transpires that another local resident had similar guidance from a gentleman who was, shall we say, less advanced in terms of his basic courteous human interaction skills.
I've emailed local access officer. I suspect they are quite busy at the moment... Another local farmer has taken it upon himself to erect signs and rather aggressively challenge folks walking on a local designated Core Path. Appears driving a tractor or car towards people whilst shouting and gesticulating at folks, particularly women, is acceptable - in his head at least. D*ck!

There is no Section 11 in place there whatsoever, I tend to nod my head at them, mention the lack of a Section 11 and be on my way. They must now think that is how I greet all folk I meet on my rides!

I saw a cracker last week on a path coming off the A9 south of Inverness. The gist of it was 'This path is for locals only, if your car is parked here you are not local and have traveled illegally. You will be reported to Police Scotland and prosecuted.' Nowhere near any buildings and the path leads straight out onto open moorland. I ripped it down and binned it.
I've had this twice in the last 2 weeks from different places. I've politely ignored both parties and just carried on.
It probably puts the majority of people off.
I have been respecting the farmers fields access if they have lambing signs up just now.
