I have a bit of an understanding with my rights, but I was wondering if the hive may assist (as this place is good like that).
Bought a child car seat Dec 2012 and basically the bit that grabs the seatbelt has failed. Now personally I think less than 2 years is a bit crap for something that's meant to last years to last. I remember reading somewhere about EU law saying we have a 2 year warranty or something?? Is this right? or do I suck it up and avoid Britax stuff in the future?? (Our older Maxi Cosi is still going strong)

For electrical goods. However, the SGA still says "fit for purpose" so you [i]could[/i] try that one on.

Shop I bought it from said tough its out of warranty. It's a safety failure so that's what's miffed me the most.

A warranty is in addition to your statutory rights, not instead of them. Goods must be of "satisfactory quality", that could mean anything up to six years.

The question you need to ask is, is it reasonable to expect the product to last that long?

IME - Child car seats have a very hard life. I would think proving yours had been properly cared for could be a problem.

Yep. People do tend to confuse the two.

I had an example only last week of a store manager attempting to avoid refunding me for an item I'd bought 3 months before, because "it's outside the store's returns policy".
He was a bit more helpful once I'd pointed out that I wasn't returning it under "the store's returns policy", I was returning it under my statutory rights (SOGA).

Stick to your guns. Don't be fobbed off!

Go back to the shop and point out that it's still under warranty and to sort it out.

edit: also check the recalls in case yours has a known fault.

I wouldn't accept the shop's response, personally. I had (and in fact still have) a dishwasher that required repairs after 22 months of its life totalling 1/3 of the price we paid for it. I kept on at the shop and gave them a deadline to cough up before I took it to the small claims court. Lo and behold on the last day of the deadline they gave me the money.

There are quite a few consumer sites that will give you all the information you need to go back to them and quote the relevant Sale of Goods Act information. I would have thought you will get them to see your side of things, personally.

No problem, I thought it odd that someone like Britax would only have a 1 year warranty. SOGA is all very well but it can be hard to prove and if there was a warranty in place then go that route first.

Best of luck. Hopefully they will replace that part as a goodwill gesture. I think it would be quite hard to prove (as per @the-muffin-man) that it had been properly looked after and for example not involved in a crash or incident which had broken the clip.

The onus of prove is not on the OP, he doesn't have to show how it has been looked after

It's the same on both sides of the seat, so it's a dodgy part.
