Today my girlfriend has been told that her department may be bought out by another company and redundancies could be possible. However, she has only been in her job for two months and it was said today that an idea of the 'buy out' was known in October, prior to my girlfriends employment start. Are there laws that the possible threat of job losses must be disclosed prior to signing a contract of employment? My girlfriend left a permanent job for this one whilst the new employers knew of the buy out possibility and didn't say anything.

No legal obligation to disclose plans of future changes. She will be “protected” under TUPE so the new owner needs to take them on and go through due process before making anyone redundant.

Although with only 2 months service she has no rights really. They can let her go without any reason.

Probation works both ways no?

Notice period for starting a new job will be in her favour?

Nope no laws that can help your girlfriend I'm afraid. You would be surprised how many acquisitions fall through or are delayed and hence it's policy to keep on running a company like normal (hiring etc..) until an acquisition occurs.

I thought TUPE only applied to private sector workers on public sector contracts??

No it doesn't, we quite often engage TUPE as part of major contractual wins/tenders and that’s in the private sector.
