My sister works as an agency teacher. Her agency does offer holiday pay in lieu of actual days off but only if she asks for it to be credited. If she does not ask within the current year then she forfeits the pay.
She realised she had to do it this year and got the request in however missed out on the prior year. The amount is not pocket change - around £3k so if there is a way of claiming it she would like to be able to do so.
Any thoughts on whether they can withhold pay as she has not asked for it in such circumstances?
Its a tricky one and IIRC a bit of a gray area. One for her union. check on the TUC website for guidance
As I remember they must remind you to take it and cannot be prescriptive when. I had a row with the NHS staff bank over this issue - and won and changed their policy
Partly it'll depend on how the holiday is accrued, statutory can't (normally) be carried over, nor "sold" back to your employer. Your contractual possibly can, how, if and why must be laid out in your contract.
If, as in this case, you can sell it back they'd be well within their rights to require you to physically do so rather than just expect them to pick it up, so long as that's clear in the contract. (legally they've no requirement to do anything more than tell you tough luck if you've not used your contractual leave at the end of the year, statutory leave they really should be making people take)
