Customer Services Lesson 1: don't let the customer hear you guffawing down the phone at them.

Lol!

On a prior occasion I had a great service from them, it just is a very rude attitude in this case.

So anyway, I then referred him to the Consumer Act, and mentioned that Garmin have a legal obligation to sell me the watch at the advertised price.

They hung up as @scotroutes says as they were laughing at this. They are under no obligation!

To be fair I don't know either way, I was just trying it on. No loss.

I did wonder if their previous email that shipment was delayed could be reasonably construed as accepting the contract, but is it really worth the hassle?

Ok, I did start with intent of just asking about my order, so yes I'm sorry to Jack I didnt think about that, that was a bit moronic of me. 🙁

That might be under an obligation if they have accepted a payment and sent out a receipt.

Look under "What happens if you don't want to go ahead with the contract?"

You can refuse to complete a sale if you can demonstrate that a mistake has occurred and no contract has been made, but an "Order Confirmation" email would imply that a contract has been entered in to.

A further twist. More fool me, I know, but I tried to cancel the one I ordered for £185 direct from Garmin after I found the Millets/Topcashback deal for £171.
Of course, I can't cancel now, the transaction is too far gone and I'll just have to return it once it arrives.

I blame 5Lab for this whole debacle.

I didn’t even know what an Instinct Watch was until Christmas Day and now I’m pondering buying one to avoid FOMO with a 20% discount. Does he work for Garmin? If so can I have my PayPal refund pretty please?

Holy breach of contract, Batman!

"If a confirmation or acceptance is automatically issued on receipt of an order, a binding contract has been formed and the supplier will be in breach of contract if they fail to deliver on the terms originally listed."

- random law firm website

https://www.howatavraamsolicitors.co.uk/selling-goods-online-when-do-you-become-legally-bound-to-deliver/

Don't think they are in breach according to that website as it states

In order to avoid allegations from consumers that they have been misled, the supplier’s standard terms of business should set out the contractual process and make clear at what point the legally binding contract will be formed.

Garmin's conditions for sale state
2.3 Acceptance of your order and the formation of a contract between us will take place when we send you an email confirming that the products you have ordered are being shipped to you, unless we have notified you that we do not accept your order or you have already cancelled it.

One for the legal bods on here but don't think it would be worth the effort to fight

Surely a contract has been entered into at the point payment is taken?

Getting into contract breaches is a bit silly over a £100 watch that most of us didn't even really need.

Life's too short.

Anyway, I've sent them a quick email quoting the law and saying they are in breach of contract, together with a delivery date request. 🚀

I think their T&Cs reasonably well cover that a contract isn't established at point of payment, or order confirmation, but at shipping confirmation.

2.3 Acceptance of your order and the formation of a contract between us will take place when we send you an email confirming that the products you have ordered are being shipped to you, unless we have notified you that we do not accept your order or you have already cancelled it.

... but, I think you could reasonably argue that their email stating that "shipment will be delayed" constitutes confirmation that the products ordered are being shipped to you. If not, the email would just have stated "order processing is delayed", surely?

Unless you paid with PayPal they didn't take payment. They only authorised payment, which is why for some people it disappeared

I did end up buying a different watch when this looked to be going sour.

Arrived yesterday but wife asked why I didn't bask for it for Christmas instead of saying 'nothing'.

Thinking back I didn't even want one then, allured by the false-bargain I convinced myself I had to have one, and ended up spending a lot more doing so.

Garmin won.

Order cancelled.

Didn't really need it anyway.

Still an apology and brief explanation would of been nice.

I have 4 Garmins, 2 GPS and 2 bike computers, probably no more now. I'm sure they will survive.

A ha! The lesser spotted instinct solar! 😆

Tbh doesn't do much different from my vivoactive 3 I guess, but the battery life is worth the upgrade, feels a lot more sturdy too mind, strap is much better, and I think I prefer the buttons over touch screen.

As someone that was fortunate (jammy) enough having placed an order and having received, in a quite timely manner, a Garmin Instinct I was musing whether there was a relationship or correlation between those that placed an order through having had a Garmin account (and other registered Garmin devices) and actually receiving them - and those that didn't and subsequently haven't..?

Just a random, gibberish thought fuelled by red wine...

Nope, plenty of Garmin devices registered in my name. Ordered at 1930 on 25th December and cancelled.

I think that from the small pool of respondents it would already seem that there isn't any correlation and the hypothesis was indeed nothing more than a random, gibberish thought fuelled by red wine…

This gets even better. Got the cancellation from Garmin last week, paid by Paypal. However the way Garmin have paid it back to Paypal means it can be up to 10 working days for the payment to clear.
Not a bad way of working with other peoples cash. Cant raise anything with Paypal till after the 10 working days.

Payment from Garmin only just cleared pending with PayPal after a whole week. I had a refund from another company and landed back same day. Garmin couldn’t even get the refund process right. No surprise given previous track record.

Probably going to stop using PayPal in future.

The refund from Garmin has apparently landed in my Paypal account, but so far has not credited to the funding Credit Card. I have already had to settle the Credit Card bill, so I have now "paid" for it in real terms, despite the refund process having been put into action.

PayPal payment just refunded into my bank account yesterday.
I couldn't bring myself to buy direct from Garmin after that. So now have one through Blacks.
When I placed the order the Blacks Topcashback was 16.8% before vat.
When it hit the site it had changed to 10%...
Topcashback terms says no payout on Garmin so we'll see. Currently about £16 is pending.

There's some semi decent deals on the fenix 6 about, with the 7 having just released.

£290 for a std fenix 6, £400 for a solar.

Does anyone rate the Forerunner 245 as a biking watch? Seems to tick all the boxes I want; Not too bulky for daily use, music for running without a phone and GPS tracking for Strava on the bike.

Got one and have been using it as my daily watch for the past 2 years.

It's great as a general fitness watch, it's specifically for running so does lack some cycling specific features, like no maps, can't use a power meter, no altimeter, etc

If you just want to record a ride for which you don't need navigation or any bike specific stuff (so just general metrics; speed, HR, elevation climbed etc) then it's perfectly fine.

Battery life is about a week if not doing any GPS recording.

I'm tempted by a solar fenix 6 but I also will be buying an edge 530 soon so there would be a hell of a lot of overlap between them. Would be nice to have the MTB stuff on a watch though so I could choose which device to use... Hmm.

Now that GPS Outlet deal is a good discount, even with that I’m still set on leaving Garmin having been annoyed consistently by their products and software.

Ill probably regret it (although I thought the Wahoo Elemnt (at release) was excellent apart from battery durability so who knows.

Bee meaning to ask this obvious question since the great customer betrayal 😉

What are the alternatives to Garmin GPS watches? I ordered a Solar due to this thread, but didn't get it. Unlike some of the mugs above, I'm refusing to give them the satisfaction of bouncing me onto a less good deal, but would vaguely like s watch that records Strava with an altimeter.

Who else makes them?

Wahoo have their watch, Suunto, Polar also. Oh and the Apple watch.

Think that's pretty much it for proper sports watches, IE not smart watches that do sports.

Being honest here.

But I’d planned to buy an alternative before the pricing error, I’d gone Forerunner 310XT, Forerunner 225, Oregon 700 and never got on with any of them. Well, I mean they all annoyed me on a regular basis.

it is frankly, time to be disappointed by someone else.

This Instinct fiasco was the best outcome that happened in my sad little watch life...

I had taken delivery of a Fenix 6S Solar for £355 over Xmas from start fitness...then got over excited and ordered 2 x PSA Instincts.

Fenix died after a week...Instincts never turned up...bought a cheapy second hand Amazfit T-Rex pro thingy and its brilliant, screen clearer than the Fenix, software fine, has touch screen and buttons, does more than I'll ever need, it's bit cheap and plasticky but that means I don't worry about it like I did with the Fenix.

Not sure i'll bother with another expensive watch!

Coros is another, slightly newer, option. Good reviews on DCR.

But must admit, I like the sound of the new solar instinct 2. The rumours are that the solar charging and kids battery drain as up to "infinite" battery life. No charging.

With 3 hours of direct outdoors sunlight exposure yes. Obviously here in the UK maybe it won't be quite so infinite, but probably still impressive. I guess with the Vals day discount we know its mot coming out before the 14th, although a Feb release is also a rumour.

It's been a long time since I posted on STW.

I've been looking to replace my trusty old Garmin 920XT and am drawn to the Instinct solar. Couple of questions. For cycling, does it display speed/distance/tine etc on screen when road cycling or mountain biking? Same for running, does it display the metrics on screen?

Reason for asking was that i read a review that said you needed to add a Speed/Cadence sensor to get this.

Yes, they'll be able to display speed for biking and pace for running, you can choose from literally hundreds of data fields for each activity type.

Here's a link to the full list for the instinct solar:

Perfect, thank you.

Somethings holding me back on this, perhaps because I don't see it as a "traditional" sports watch, like i've had in the past. Don't want to make a mistake, looking at the 935 and 735 as well.

Are any of these watches particularly user friendly?

My mate just moved from a TomTom to Garmin and says it's far more of a ball ache using it. Apparently the old one was select sport > go > stop > save where as the new one is 300 button presses longer.

Your mate probably just needs to get used to the OS.

On my forerunner 245 (it'll be the same for 90% of Garmin watches) if I want to run I press the start/stop red button once to go to the activity menu, press it again to select run as it's at the top of my list, wait for GPS lock, then press the same button to start.

To stop, press the same button, then I can choose to resume/stop/discard etc with a couple of button presses up or down.

Literally no more than 5 presses to do anything regarding activities, including scrolling through options.

Just had a look at the TomTom watches, they're very basic which means practically any Garmin is going to have vastly more options, data, menus etc etc than his old watch. Once you've used it for a while it becomes easy.
