So if for example you have a brand new bike and you strip parts off it and eBay them as new other or new the buyer can get a partial refund unless you list as used.

I agree, no private seller is in a position to offer warranty on a new, boxed, item.
Seems daft they'll let you sell something as new under those rules.

It's only "new" if you're a business selling the product, which the selling regs apply to. This includes providing a warranty service.

If I take parts off a bike then sell them, I sell them as used but as-new condition- they're not new, even if they've not been ridden they've been fitted.

As far as I can see private sellers still have the option to specify their returns policy. And you can list as "New - Other" and describe how it's not a bnib item.

Even if something had arrived from a shop, unopened and i'd listed it straight on ebay, i would never list it as "new".
They are used goods, sold as seen (or described in the case of ebay).
Though I have frequently said "as new condition" in the description if it really hasn't been used.

No, the choice is NEW or USED. There's no second hand option on Ebay.
If you haven't USED it, it's NEW (other).
"as new condition" and "new" are totally different things.
For eBay, this would be "New (Other)" and "New"

ebay refunded him £40 that he asked for. good job he didnt ask for more!
Update- after appealing ebay found neither party to be at fault and have refunded him out of their coffers.
Result.
So no actual policy change from eBay?
