Afternoon everyone,

I got a parking ticket recently from the council. Parking on a single yellow line.

I made an informal appeal stating that I was 'only just' on the line... 🙂

Result: refused.

So now, I have to either cough up half the fine or make an official appeal and if I lose, end up paying the full £70.

So, oh well, life's too short right? Was just about to pay the reduced rate fine when I took another look at the photos the traffic warden had taken. I hadn't noticed the first time around, but I'm parked (just) on a single yellow line over a dropped kerb, to the driveway of my OWN HOUSE.

Is it worth challenging this? I mean, I'm not obstructing anyone right? Or is it just a question of 'computer says no'?

I suspect not - yellow line's a yellow line but at least it's a council and you might get sympathy more than you would from a private parking company

No, if you contravened the yellow line you're guilty, the line isn't there to protect access to your drive, it's there to aid traffic flow. I'd pay up pronto and learn from it, the council have more enforcement powers and less need to keep customers on board unlike private parking companies. On a point of clarity I doubt you've been issued a PCN, it'll be a proper fine.

Edit it'll be a penalty charge notice rather than a parking charge notice.

How deep do you want to go?

I single yellow line is a waiting restriction rather than a prohibition. Therefore, they will struggle to say that the SYL was a safety issue (unless near a school - but there is a counter arguement to that as well).

How long has the SYL been there? How long have you been there? If you outdate the SYL, were you consulted on it before the traffic regulation order was made? Is your drop kerb official and recognised or is it a retrospective bodge on the cheap where you (or the previous owner) knocked the garden wall down on the cheap and had some kerbs put down by a mate of a mate one dark evening?

Have you read the traffic regulation order relating to that restriction? Does it match? The schedules are often out enough to invalidate it.

Do you know that local councillor for your ward? The amount of stuff we were instructed to do counter to policy just because a councillor wanted it was rediculous.

Yes, It's a Penalty Charge Notice.

I've been there about eight years. It's a proper dropped kerb. I'm pretty sure the line used to be white. They re-painted all the road lines last year and now they're yellow. Not %100 sure about that though.

At the end of the day, I've got better things to do than fight some epic battle through the courts just to prove a point. But at the same time, I don't want to pay it if I don't have to. I mean, I've parked there loads over the years, because, well, it's my drive and I'm not obstructing anyone.

I've had a quick look online about this and read somewhere that you're supposed to let the council know that you have a yellow line in front of your driveway and you won't be issued a PCN, but I can't find any info about what to do after you've got a ticket...

They can't just paint white lines yellow. White is an advisory marking, yellow represents a traffic regulation order. Unless there was a public consultation, there isn't a legal order. If there's no legal order, there's nothing to issue a ticket against.

Some local authorities activate powers to enforce against dropped kerbs. These are either drops off footways which are considered theirs. The others are over driveways. Typically, they will enforce those with a counter signiture in the pocketbook from the homeowner.

Edit: my mistake, they've always been yellow. Just worn away and barely visible in parts. They were re-painted last year.
