Got a final demand PCN yesterday for the wife's car, £99. Issued at Grimsby Institute on 21/02 this year. It came with her registration number but seeing as we've never been to Grimsby in our lives I went on the company's website to view the photo evidence. The offending car (which deserved a ticket for the way it was taking up 2 spaces) was a similar number to ours, close but no cigar. It was also a different model.

So I filled in the 'appeal' form & advised them to check their details.

I'm assuming the ticket will be void cos the reg number's wrong?

Assuming it’s a [b]Parking[/b] Charge Notice rather than an actual PCN then you can just ignore it, no need to bother getting it cancelled. Best case scenario (if you’ve got the time!) is they take you to court, the judge makes them pay all costs & you laugh at them lots.

I suspect they will chase you anyway. It is pretty much an automated process at this point. Don’t be surprised if you’ve lost the right to appeal as your outside some timeframe the company have set.

Remember you have to prove absolutely nothing to them.

you’ve done your bit by alerting them to their error.

ignore everything else apart from court papers

Ignoring it is generally a bad idea (though it varies depending on the issuing company as to exactly how bad).

"You've got the reg number wrong" seems a valid defence to me.

Don’t be surprised if you’ve lost the right to appeal as your outside some timeframe the company have set.

Ignoring is usually bad advice.

In this instance once you have made the PPC aware that they have misread the reg number that is the end of your obligation.

contacting them usually marks you as a “target” someone who will engage and could be intimidated into paying regardless of whether you were there or not.

you have to bear in mind the basic premise that PPC’s work on. It’s basically scare tactics.

What OP needs to think about is if the PPC continue to harrase him after telling them they are mistaken he has a solid claim  for data misuse under the DPA

there may be a claim against both the DVLA  and the PPC for misuse of data. It could be worth hundreds.

Feel free to check out case law.

If the OP wants to be super reasonable, reply once with the full appeal then just reply with “ refer to previous correspondence”

if that goes to court you should be able to claim costs, and harassment.

there was a case against British Gas that set the president for costs for harassment.

hopefuly they’ll check the pics and realise the mistake.

I'd edit that pic of your car reg. All sorts of shysters out there who will happily put it on a similar vehicle.

Worth checking with DVLA that you aren't registered with them as the keeper of the other car.  It seems they sent the parking company your details.

From what he says, the DVLA sent his details having been (incorrectly) supplied with his reg number. I'm guessing that right there is part of the issue which MartynS refers to - there are quite strict rules on the use of the DVLA service and asking for details of a car which you have no dealings with would appear to be breaking the T&Cs.

Or just make one up.  ZX64 CPC.  There you go, prospective criminals, you can have that for free.  I can supply more at £500+VAT for a dozen.

One advantage of trawling a car park / back street of course is that you can take a screwdriver and not need plates creating.

It may have been DVLA sending the wrong details, not the parking company.

Is there any legal obligation, whatsoever, in this case? Someone sends you a bill in error, for services someone else has "agreed" to pay for… what is your obligation?

Same thing happened to me a couple of years ago. No email address, no telephone number, just an address to send the fine in a certain number of days.. They were part of some larger group and I managed to find out the telephone number of their head office. Spoke to a person there who could not find a number for the company even though she confirmed it was one of their companies. She said she would get back to me with some information. To my surprise she did and told me she had sorted it out. I had a letter confirming this with an apology. I sent them a bill via email for the cost of telephone calls and and my time giving them seven days to make payment. Received nothing!

Is this not just the standard fine issued (erroneously - Obvs) to all owners of Nissan Jukes? It's a **** tax!

I reckon that what happened was... the person who stuck the ticket on the car had sausage fingers & put an H at the end instead of a G. Owner/driver of the Juke came back, looked at the ticket & says, 'Ha!, not me' & binned the ticket. As someone else said, It's probably all been automated by now & no-one's checked the photo's against the reg no on the ticket.

I HAVE done the appeal form & pointed this out.

But did you send repeated threatening letters? Pass it on to a debt collection agency who give up and pass it back to you? Then threaten them with court? And then if still no response, go quiet for a couple of years then try again?

If not, then you don't deserve the money for giving up too easily.
