Bought a new Garmin Fenix 5s from a U.K. based retailer. Turns out it wasn’t new but “newly overhauled” and came without original packaging etc. Listing didn’t mention this.

Retailer admitted error and said send it back for refund. I did, using the cheapest insured service possible - no way I want to be £400 out of pocket if Royal Mail smash it up in transit...

Retailer now saying they’ll only refund secondclass postage leaving me a few quid out of pocket for their mistake (although they are still listing identical items on eBay as “brand new”!!).

I know it’s a pretty trivial amount and doesn’t require bombers but other creative / amusing suggestions welcome! 🙂

Send them a polite message saying that the whole experience so far has left a negative impression on you but you hope that you can work together for a positive result.

Polite message tried - no luck!

Red Rock UK and bought direct rather than through their eBay shop...

Not a dig at the OP, but when you see on e-bay something being advertised for much less than the normal price, don't you think "something likely to be wrong with that" ?  I rarely buy stuff on e-bay for exactly this reason. Maybe I'm missing some bargains!

Presumably it was cheap?  Why did you send it back?

No, not if it is from a trader, more likely if it is from an individual. I think, there's a reason they are selling it at that price but the reason may be that they can make more money by selling more of them. Or any one of many reasons. There are laws about describing stuff.

try phoning them and asking them straight if they would have refunded had it gone missing sent second class ?

ASk them if thye posted it to you second class

then ask them if they think their response is suitable.

people usually find it alot tougher to act the dick in a phone call - and even tougher face to face.

spend £1.77 on a recorded delivery letter with some vouchers for them to spend with the money they have saved

like  a Mcd's happy meal -£2.79 X not - make it add up to what they saved  ..... or just forget it

Ebay's policy is that the seller pays the return cost if it is not as described.

https://www.ebay.co.uk/pages/help/buy/return-item.html

However you are supposed to follow the sellers instructions. If they didn't specify it, **** em, open a case.

if you paid through paypal you can claim return postage upto £15 through them, max 12 items per annum..

no help for you as you have to agree and activate before hand, but a great tip otherwise

Reference the point earlier - it wasn't a massive bargain - a few quid cheaper than Amazon / Millets, but only about a tenner. Not enough to be suspicious and certainly not enough to suggest it was a refurbished item. Main reason I ordered it there versus Amazon was that it was a colour that was out of stock elsewhere..

Anyway, despite previous nice chats, no progress. The response to "What would have happened if it had gone missing?" was that they had an insurance policy to cover this kind of thing. How that would have worked as I posted it so had the contract with Royal Mail not them... Anyway, got a bit shirty and they're refunding the full amount. Frustrating process when, by their own admission (in writing), they were at fault in the first instance!!

So....... buy from them, claim to have returned item, but not do so, get a refund, claim lost in post so they can claim off their insurance, and it's only the insurance people out of pocket?

Gotya, what's the most expensive item they have online?

Do they sell lynching mobs?
