I got NIP’d the other day.
When I logged on to look at the evidence, the first image shows a single car and some text super imposed. One bit says 82mph, hence the nip. Fair cop you might say, But the car isn’t mine. I can’t see the reg but it’s clearly a different make.
The next pics are close ups of my car. These pics have some codes super imposed but no speed shown.
Anybody had a nip and had it cancelled without going to court?
What is a NIP?
It’s what Line of Duty fans call a speeding ticket.
Notice of Intended Prosecution
Check to see if there's a location on the paperwork and if it's local / somewhere you've been.
Also 82mph is stepping on it (indicated 90+), wouldn't you be able to remember if you'd been driving that fast?
You could write back and explain that since no one was injured no crime was committed, which seems to be the stock response from the police for dangerous passes and road rage towards cyclists.
@flaperon Exactly what I thought- I wasn’t doing enough to give a reading of 82, which would be 85 -90 on the speedo so I definitely wasn’t going that quickly. Trouble is saying honest gov I wasn’t going that quick is of no defence at all.
I think the speeding car was over taking me and then stepped on the brakes and basically stopped when they saw the camera so the first picture is of the them and then the close ups are of me.
Well if its a completely different car to yours its either an error, or your plates have been cloned.
I wouldn't start speculating about any other possibility. Those are your defences.
ring the camera partnership and let them know. They can then re-examine the photos. I think you still have an obligation to name the driver (S172 request which is what this NIP is basically)
I know its not you but dont get caught out by not fulfilling the request. The punishment is worse than the speeding offence.
I'm sure the camera partnership will be able to advise
Surely you just need to tell them you were overcome with the luxurious interior
It wouldn’t be the first time the computer has misread a number plate. Just contact them and say and a human should look at it and sort it.
I would contact them too and also send a follow email asking for their response in writing.
Basically make sure you are covered if it goes to court and the say they have never had any communication from you.
Not that I think this would happen, but pays to be cover your ass etc.
Respond to the NIP as required but state in a covering letter that the initial image of the speeding car and the close up image to confirm the reg are not the same vehicle. Send your correspondence by recorded delivery. Any response by you to the 172 Requirement that contests accuracy in any way should automatically trigger a physical review of the images by a staff member. Normally you can make an appointment to view the images at the Safety Camera Partnership viewing room but Covid may scupper that option. Record dates of all correspondence and make copies of everything.
I've had this recently - but mistaken identity or cloned plates - the images were pretty blurred. I was at home at the time. I did speak to a solicitor through my car insurance and the advice was pretty much as above - fill the form in because the penalties for not doing so are severe and append a letter. I've also found its impossible to speak to anyone - all communication is by post or email - so don't expect a quick response.
