I had a small car accident in August. I of course believe the other driver was at fault, and he believes that I was at fault, but that is largely inconsequential (I think).
I had the repairs done, paid the excess, and to date have not bothered trying to recover any losses, as my only loss was the excess, no injury or hire car etc. so until liability is resolved then what is the point.
I recently had a letter from my insurers saying they had written to the third party's insurer asking them to reimburse them for their losses within 14 days. Ok I thought, but as a letter it did not tell me a great deal!
Yesterday, I had a further letter from my insurers saying that if the third party's insurer did not pay up in 14 days (I assume they have not paid) then my insurer would take legal action against the third party.
Is this usual? I thought the insurers came to an agreement over liability, or accept knock for knock. I cannot help but think if my insurer is playing hardball, then I am also likely to be on the end of it from the third party's insurer?
Thoughts?
Sounds like the other parties insurance are playing the same game as yours. Only one outcome if there are no witnesses and that will be 50/50.
Yep, no witnesses, plenty of other cars but on a very busy roundabout in the rush hour understandably no one stopped.
