Long story short:
New motorcycle, serious corrosion in less than 5 months.
Spokes pitted and blackened, coolant pipes blistering through paintwork, exhaust rusting and worst of all, serious rust around front of fuel tank and brackets, looking like it will soon cause a major issue!!! ( I’m not the only one either)
I have emailed the manufacturer and received a generic, it’s all your fault, email back
Contacted dealer and they were decidedly generic in their response too. I haven’t had a chance to go to the dealers yet as its a very long way.
Bike has been cleaned, oiled etc regularly and not even used on salty roads.
I have never had a brand new vehicle before and I would say this is entirely not fit for purpose ( it’s a bloody adventure bike). I have 40 year old bikes in better condition!!
How do I approach this to Make sure this gets sorted under warranty? What legal weapons can I arm myself with? As I have a feeling the manufacturer fully intends to wriggle out of any liability.
Sorry wasn’t that short after all
Cheers
I had horrific experience with a major motorcycle brand when it came to a new bike
I signed a gagging order which I wish I hadn't now but would have cost lots in solicitors fees as my legal cover did not cover faulty bike
Lots of known issues with my one too
Dealer was a right ****
Dealers are stealers
Etc etc
I can only wish they drown to a miserable death in their profits as it literally changed my life for the worse having had an accident due to result of faulty bike and utter appalling service by dealer
I hate them with a passion! I made sure they knew that
Caused so much pain and still suffering the consequences in many different areas of my life
Thankful though that it was not 5 mins later on busy main road
I would strengthen your
correspondence with all evidence detailing the poor quality of the bike whilst copying in trading standards and maybe seek legal advice as to ascertain where you stand before it does cause harm
Makes me sick to the core as motorcycles simply are not tools fit for purpose
Merely endless money pit toys
Shame as I loved riding everyday to work and for pleasure
Haven't ridden for many years now and it sucks
Anyway I feel your pain and would say to make a judgement call on if you feel it is worth risking your life riding it as it will only deteriorate further
Check the "Which" website for advice
IIRC at less than six months old they have to prove it's not a manufacturing fault
Is it an unknown Chinese/Indian brand being imported by a UK box shifter?
Tenere 700 I think.
Once polite route exhausted I would think the most effective solution is to park it outside the dealer and have a chat to every prospective customer going in. Pretty sure that seeing a six-month-old bike with the fuel tank about to rust away would put me off buying. Even if it doesn't solve the problem it might make you feel better.
AFAIK there's nothing that says you can't plonk yourself on the public side of the entrance into their car park and talk to every single person entering.
Correct, Yamaha tenere 700... last yamaha I’ll ever buy, even if they do sort it under warranty. Very poor build quality for a premium manufacturer, even if designing to a price point.
I’ll stick to 30 plus year old bikes. Far better it seems
Go to a different (better) dealer.
If it's warranty, any dealer can deal with it.
And by a strange co-incidence, my mate bought one of the first re-issue Tenere's. And his rusted horribly.
The dealer did sort him out though
You have two routes to consider. The Warranty is a contractual thing between you and the dealer which may give you rights with manufacturer - but it only covers what it says it covers. Your legal rights under the Consumer Protection Act apply to the dealer and may well be greater then the warranty, particularly as, within 6 months of purchase, any faults are assumed to have been present at the time of purchase. After 6 months you have to prove that which is a lot harder. Google (in this case) is your friend.
Non supplying Dealer is unlikely to welcome you with open arms. Warranty work pays dismal labour rates so most will claim that they have to prioritise their own customers when it comes to workshop time.
What sort of mileage have you done, how much off road and has the bike got any signs of accident damage?

Consumer Rights Act, but yes, basically this. They are legally obliged to make good or prove that it's not an inherent problem. Don't mention warranties, it's an irrelevance, any warranty is in addition to your statutory rights, not a replacement for them.
Warranty work pays dismal labour rates
Spoke to a KTM dealer about this, they get paid £56/hr by KTM, which isn't dismal at all.

But what do they charge Joe Public per hour ?
Take the ruddy thing back. Tell them its not up to standard and that it is up to the shop to sort it out. repair, replace, refund!
