So I understood perpituitery to mean "forever". But a document I'm looking at states "road constructed by .... within a period of 21 years..." "...which for the purpose of this ... be the perpituitery period.
Its to do with the sell off of some land by a property owner to a development corporation, which can then still remain to be used as access to said property by the owner.
Does it mean the access only lasts for 21 years? If not, what?
usually, in the context you mention, it relates to the implementation of future easement rights i.e. the free running and passage of services through the service media now laid or to be laid within the perpetuity period. it can relate to access and rights of way similarly. it means that the right must come into being/be exercised within 21 years however the law on perpetuities has changed recently so you should get it checked out properly.
