Driving to work on the M1 this morning and the sky was amazing. The woman in a Mercedes in lane 3 obviously though so too as she was driving along in rush hour traffic taking photos of it. She had her phone upright, in portrait. How stupid do you have to be to not know you'd get a better photo with it in landscape orientation?

Though obvs that doesn't mean it's a smart idea, or totally legal, to snap away at the sunrise while "making progress"

Some people are happy to assume that the distribution of intelligence is symmetrical (or loaded towards the lower end) and that half of people will have below average intelligence 😉

(Or answer the question, do you have an above or below average number of legs (Edit - for a human)? And are how about the people you know. I bet most of them also have above the average number).

Baretto just means that a prosecution under s41d(b) must show an interactive communication function (which may or may not have been the case here).

The high court were pretty clear that they see filming whilst driving as likely to be at least careless driving and possibly dangerous driving. That’s 3-9 pts or an automatic ban respectively. In any case, where penalty points can apply (including the “lesser” 41d(a) offence or C&U provisions that might be broken by displaying moving images in sight of the driver) the sentencing judge has the option of imposing discretionary disqualification.
