Just got wind our buyer has backed out of the house sale, the estate agent we sold with I had already served notice on the contract and they managed to sell the house at the 11th hour, at this current time with an unsold house there is no contractual tidings between us.
Whilst I was informing the solicitors/esate agents we were buying from/mortgage broker/the mrs of the news its past closing time at the first estate agents, so I have been unable to contact them.
If the buyer has pulled out of our sale, do we owe fees to the estate agent, our contract was no sale no fee, so technically they havent sold it right?
If the sale didn't complete, its no sale so no fees
If you exchanged contracts then you are due to get purchasers deposit and the estate agents would want payment out of the deposit, but it doesn't seem that you are in this position. So no sale, no fee.
Nothing to worry about fee only payable on sale.
it depends. A lot of the cheaper, online-only places are fixed-fee whether you sell or not. I haven't seen any bricks-and-mortar type places with that model, but I bet there's some out there..
