Looking for advice regarding an accident I had on tuesday.

I was commuting in to work at about 715, heading straight on on a narrow resedential road, parked cars either side. Car pulled out from the right, floored it and hit me head on.

Fortunately I was fine - I chucked the bike in to a garage of some onlookers who lived by the accident, the driver lifted me to A+E and I was given the all clear - I work in said A+E and was even able to start work that day.

The bike, not so much. Initially I (stupidly) agreed for her to pay to fix the wheel that was pringled as I thought that was going to be the only issue. Not sure how I didn't see this before, but of course, the carbon forks completely dead also.

I have the drivers mobile number and she's already paid me for the costs of a new rim + wheel rebuild. Now I've found the forks cooked, I could just ask her for another £110 or so for a surly fork and that would be sorted (not quite like for like of the kinesis carbon fork but hey ho)

In terms of insurance options, have I left it too late? Police weren't called when it happened and haven't been since. I don't have any cover myself - but I'm certain I could claim of her insurance as she pulled out on me so insurance should see it as her fault.

fact that she stopped, lifted you to A&E and has paid up already for a wheel makes her sound reasonable to me.

Tell her that the LBS have checked it over (I assume as you havea quote for the wheel, or get that done) and the fork also needs replacement. Does she want to pay that, or now put through insurance and you'll give her back what she paid for the wheel already.

And why should you settle for a Surly fork in place of a borked carbon one? If she smashed your Ford Focus would you allow her to replace it with a Fiesta, because you're nice?
