Just wondering where I stand on this ? ... I had the misfortune of accepting a job at the local council recently and Hated it with a passion , so much so I walked away after a week etc, end of the month received no payslip etc, so assumed they hadn't even bothered paying me. checked bank and they had , but not the correct amount ?
then last week I get my P45 with the correct amount on ....
I did receive a email from them this week saying they had over payed me , but that was that, nothing else and then today I get an invoice through the post demanding this money back.
where do I stand ? .. do I pay them back ? , argue the toss and ask for proof etc ... can they get debt collectors banging on my door ? ... or do I say they can have a tenner a month back ?
As above I have no proof of what they paid me as in payslip etc, only my p45 which has the correct amount on

Yes, if you agree that they overpaid you and the number on your P45 is right, you pay back the difference.
To do otherwise would be dishonest, may even be theft legally.
If they have overpaid you, no idea why you haven’t for a payslip, then you owe them the money and have legal obligation to inform you were overpaid.
As above, just pay it back. This is how folk end up with CCJ's and then wonder why they can't re-mortgage.
Do you have any reason (beyond liking money-who doesn't?) not to just do the right thing and pay it back? I e. do you think you were misled about the role and feel agreived?
Otherwise, just do the right thing. Even so, probably do the right thing. The fact that they are bothering to chase you as much as they have already means it probably won't end well if you don't.
It sounds as though you are standing in the circle that states you want to keep the money even though you are aware it is overpayment and a mistake.
I'd repay the difference back to them as that is the right thing to do.
Cheers for the above advise, did think about buying a new frame if I'm honest ... as for the job .. yeah bit peeved, as wasn't as advertised etc at interview .. but that's another story!
Moneys sat to one side, so will send it back next week as don't want anything like CCJ's etc around my neck

You have to pay it back legally and it could go to debt collectors if you ignore it for long enough (depends entirely on the council). If you wanted to set up a payment plan to pay it back (e.g. £10 a month) then they're likely to agree to that.
Keeping it would be theft and councils are mostly taxpayer funded...
Ask for the payslip showing hours worked, payrate etc.
Think it's illegal not to provide you with one (either digitally or paper copy). It certainly used to be. Then at least you can see their working out...

Yes, ask for the payslip. And if it doesn't tally with the figure they paid you request a statement showing their calculations.
But the calculation will just say we paid you X but we should have paid you Y, you owe the difference. I don't think it will say any more. The OP should know what they should have been paid for the period.

They accidentally overpaid you. It's not your money. You hating the job is a separate issue. If you don't repay the money, it becomes theft, plain and simple. I'm sure that's not who you want to be.
When I worked for the LA they paid me 2 weeks in arrears and 2 weeks in advance.
They sort wages out a week before they are due. The admin after you walked away probably caused the overpayment issue.
Just pay it back. You can always agree a monthly repayment amount to spread it out if you are short of cash in the short term. Its not like keeping it in the banks is going to do anything

Side story, I left a job and two months into my new job my old one started paying me again. Rang them up "thanks for telling us, we'll send you details of how to pay it back". Nothing received
Next month they pay me again, called up again to let them know and even wrote them an e-mail. "Thanks, we'll let you know how to pay it back". They never did.
The paying me stopped but three years later I spent it on a house deposit having made all the effort I could to get them to take the money back.
They went bust about 4 years ago (over 10 years after I left) but despite them being a large international company I did worry someone would do through the accounts and find out I owe them some money!
LOL I had this once years ago where a firm made me redundant (yeah thanks, three months before my son was born as well) and then somehow managed to pay be four time the redundancy amount I was actually due. I remember looking at my bank statement and thinking how ironic it was that it should be this payment they screw up.

Before I paid anything back I'd want a proper payslip for what they did pay you and an explanation of what you were owed etc.
At least you would then know you're paying back the right amount - they screwed up once, they could screw up again eg demand back gross (pre tax) when they paid you net (after tax had been deducted).
On a vaguely related note, I was made redundant a couple of years ago (company became insolvent) and over the next two years got various random cheques for money 'I was owed' most of which I can't explain! My final cheque for £145 arrived this week for an apparent £9k I was owed (no idea what that was for) - the final settlement was about 1.5p in the £ for outstanding creditors.

The morning she started after her leaving her previous job she was told the job she applied for and got was no longer on the table and she would be doing something completely different.
At lunchtime, she left and never went back.
At the end of the month she was paid in full for the whole month 'with thanks'
Several years later, after maternity leave she went back to the school she worked at and was told she was overpaid while off and she would have to pay the extra back. She agreed, and nothing more was ever heard.
It's not really their money, so they are very careless with it.

Was there not a contract of employment with pay details and notice periods?
Surprised they didn't just take it back out of your account - that's what happened to me over the winter when a company I worked for six years ago randomly paid about a week's wages into my account. I left it there, wondering what would happen the following payday...and by then it'd gone! Bank sent a letter saying I could dispute it - didn't, obvs, but did contact company telling them to get my confidential info the **** off their computer if they were that careless with handling data.
But, yeah - give it back.

I’m amazed that there is any discussion here. If you know what you should have been paid and what you have been paid then if you keep the difference it’s theft. If your employer never noticed then it’s still wrong but you got away with it. Since they did then obviously you pay it back!
