Hi team,

After some advice if possible.

Eurocamp have amended their policy, now offering a credit note for your holiday, which if not used by 31st March 2021 you can then apply for a cash refund.

Can they do this? Is there any legislation that would protect consumer or should be quoted to avoid this/challenge it?

We’ve had the same.

As you say the headline is a free rebook or a credit note, if you don’t use it by March a refund.

If you dig deeper it says that if you CAN’T travel because it’s against FCO advice and/or the country you’re visiting aren’t accepting tourists then you can refuse the voucher and have a refund.

The tricky bit is that (well according to an airport transfer co on the EU Holiday thread) is that whilst France (assuming France is either where you’re going or at least travelling through) isn’t fully opening until the 25th of July, they’re now not making Brits go into isolation for 2 weeks so we’re free to holiday in France from June onwards, subject to Boris’s announcement on Sunday.

I suppose it depends if you want to go or just want your money back.

This is slightly what I was afraid of. I guess worst case is take the credit note and hope they don’t go bust! It seems pretty unethical but then they’re trying to protect their cash flow.

I’m in a similar boat, but horribly complex.

I’ve only paid £100 which I’m not fussed about.

We’re supposed to be going at the end of July to a Park near Paris, they reduced the pay by date to 6 weeks before, about mid-June.

My FIL passed from Covid about a week ago, at the moment I’m on the hook for the funeral expenses, if that happens we can’t afford to go, I’ll take the credit voucher and call it a day. There’s a decent chance however there’s some money in the estate and we’ve been offered a grant from the Nurses Union to help with some of it, if that comes to pass then we can go.

I’m happy to go end of July, it’s actually the day after the last stage of their current staggered lock-down, and we’ve already had Covid, but I’ll have to decide mid-June if I fancy risking another £1500 on it, will we be able to go, should we go and if I’m honest, is it wise to spend £3k on a holiday (inc spends etc) without sounding too dramatic it’s 3 months mortgage to us.

That sounds very tricky. We are very much resigned to our holiday not happening. Was going to be the four year olds first trip abroad!

Hopefully we will get our money back and be able to take a domestic UK break in the summer.

Be careful P-Jay.

Just beacuse you have only paid a £100 deposit does not mean that you are not necessarilly off the hook for the rest of the dosh!

I spotted that the Eurocamp FAQS said "please note our cancellation terms and conditions remain the same". I then looked at the t&c's and "A cancellation charge will become payable by you to cover our reasonable costs including any cancellation charges set by third party operators". The scale is: before 84 days you lose the deposit, 29-84 days 50%, 22-28 days 70%, 14-21 days 90% then 100%.

Now I admit they they may struggle to get the funds out of you without a jolly good arguement but if you leave it until the end of June to decide I suggest that according to the t&c's you will technically owe them 50 to 70% of the holiday cost. Doh!

I am sure that Eurocamp will try to play fair and have the very best of intentions but if it is any consolation I have today given them written notice that I wish to cancel. I expect that I will lose a £99 deposit that I paid last year.

Hi team. So for info they’ve now officially cancelled ours. This is the wording they use. FYI I’ve emailed back saying I will accept a credit note but for a maximum of 6-8 weeks, so accept it takes them a while, but not March 2021

“We’re emailing to tell you the sad news that your upcoming holiday cannot go ahead. We have delayed our 2020 season in line with FCO advice to protect both our customers and staff during the COVID-19 outbreak.

Within the next 7 days we’ll cancel your booking and apply an ABTA approved refund credit against your customer record in our reservations system. This will be for the amount you have paid towards your booking, and is valid for any booking made before 31 March 2021. You can use this credit for any holiday in 2021, so you can start looking forward to your next escape!

Financial protection
For your peace of mind, your refund credit is financially protected by ABTA until 31st March 2021. If you have not used the credit by 31 March 2021 you can request a cash refund.

A word of advice for those doing their own thing with travel and accommodation for holidays. Ensure you book another service from the accommodation provider. Hire a bike, a guided tour or something similar.

This makes your booking a package and you get insurance protection from UK companies for your holiday money under the package tour regulations. Any provider that doesn't bond/insure your money commits an offence that trading standards will take up for you.

Hola! So Eurocamp have come straight back and agreed to refund me. Impressed - looks like they’ve found a more balanced position than the last few weeks.

My email had just explained why a credit note wasn’t useful, empathised with their position but just confirmed the official ABTA guidance and asked for a refund in a more timely manner than March 21, ie the next few months.
