Ok I'm going to have a look through this:
http://www.moneysavingexpert.com/reclaim/private-parking-tickets
In todays post came a penalty notice for £100 for ‘failing to adhere to signage on the site’. I parked on the site on the 8th Feb and I left within the stated time (I remember as I was only there for 20mins max to pick someone up from a nearby pub and cameback within the allotted paid time. There was nothing on the screen of my car and if I overstayed where is the proof?
The letter received states that I’ve failed to pay the notice within the time specified therefore the amount has increased to £100.
This implies that it is a second letter.
I never received a ‘first’ letter. I receive all my mail. Never missed a delivery, never had anything go missing en-route so I imagine there was no first letter. They simply skipped to a £100 charge (a new tactic?).
Does anyone have experience of Euro Car Parks (or similar) and how you dealt with them?
The letter is dated 5th March. Today is the 11th. Why also did it take so long to reach me?
I wont be paying £100 but I wont be filing the letter in the bin either.
Pepipoo is your friend!
Round filing cabinet and they go away eventually.
Failing to adhere to signage could mean that you parked out of the bay or over a line or something similar.
Don't ignore it though - the law changed some time ago now which means they may well pursue it.

If you're in England or Wales, dont' ignore it. Not sure if Euro car parks are part of POPLA but if they are it's easily killed.
I was definitely in the bay. I'll also ask them for footage and recheck the bay tonight (I was up against a wall/reversed and remember it well).Failing to adhere to signage
I'm not going to file it in the bin.
You are not alone Hora.
I had one this week, the wife parked in town (deansgate) and overstayed by 5 mins. they reckon it'll cost 100 quid but will reduce it some 60 (ish...cant remember) if we cough up ASAP.
they can go do one for all I'm concerned, not going to ignore them but ill appeal and them take it to POPLA. I'm going to make it quite clear that they can take me to court if they insist.
Same carpark I think Chris- across from the hotel?
Did you receive the/a first letter?
I have had three of these. On the husbands advice (it was his car) we ignored. Have heard nothing. Contract law states that they can only sue for their losses, ie a couple of quid. If they ask me for a couple of quid they can have it, but they didn't..
that is indeed the place.
it was the 1st letter, dont have it handy to check but I dont think it reads like a 2nd letter.
She is willing to pay the 'fine', out of her money obviously but seems to forget we dont really have her money and my money, it all seems to go to /dev/null
funnily enough i was checking the place out on streetview and there is our car...different day mind. I've always insisted she spend too much time pishing about in town on her days off.
I think the not agreeing will be the leaving and returning bit
best check the rules on that in the law and at the car park
I've checked the cameras hora they only cover the entry/exit points so you weren't done for parking like a tart. it'll have been overstaying
This is the thing- how long are you allowed to get back to your car for, load anything, faff then leave?
They are charging for TOTAL stay then?
Imagine you were in a multi-storey, faffed etc and were blocked at the exit....they let you out but they also have a certain length of time built in regardless for floors/faff etc.
They know all this huh- you pay till 5.30pm. Then you'll be back AT your car ready for 5.29pm. I wonder how many are charged this way leaving the exit through that camera at 5.32pm... etc
Total scumbags. Former employers car park was managed by them. We asked for passes for the staff and despite staff parking in allocated parking they still continually ticketed staff cars. My manager caught one of them ticketing my car and explained I worked there. Ten minutes later the guy came back and ticketed my car. It took 8 weeks of emailing and phonecalls to get them to cancel the ticket, all the while they continued to send ever escalating threatening letters.
On top of that, someone hit my bumper and fled the scene. I contacted ECP for video of the incident to see who it was and they demaned £90 per hour of footage.
The wardens at that car park used to dress in track suits and beanie hats, and would literally hide to catch people.
according to the camera timestamp she was 5 mins over (paid for 4 hours).
if she had been taking the piss them maybe I'd fold but 5 mins over a 4hours period. they can do one.
I have 1/2 a mind to just ignore them.
So shes got back to the car. Throw bags in boot, coat off, walked round the side, eased into drivers door through gap, seatbelt on, checked mirrors, started up, eased out of space and round towards exit where she passes the exit cam.
Bingo- at this point she is now ticked over the magic time on display/receipt.
Nice.
don't do that. POPLA.Round filing cabinet and they go away eventually.

couple of cases recently in the papers and on bbc news where defendants (you) went to court and the otherside didn't bother to turn up. the judge then went through each case and said they were not enforceable for various reasons. also check out the cab website here http://www.adviceguide.org.uk/scotland/consumer_s/consumer_cars_and_other_vehicles_e/consumer_driving_and_parking_e/consumer_parking_tickets_s/parking_tickets_on_private_land_s.htm
in anycase let them do the donkey work it's up to them to prove any case
the coop carpark opposite my work place has a 2hr stay with camera recognition. Both work colleagues have overstayed and ignored all letters, they didn't pursue it beyond the usual rhetoric (letters more letters then ...silence) last month they introduced "larger signs" ..but and get this.. removed the cameras? that was 4 weeks ago and the cameras haven't returned? chancers..complete
Looking at their website it looks like they lease land to turn into carparks. I imagine if a carpark isn't repaying its costs they'll seek revenue to top up that site income and service the overheads.
Chris- I'm going to write (one of my points):
(if anyone could word it better I'd much appreciate it too).
Could you please supply proof of the alleged contravention. There was no ticket left on the windscreen and I left the bay within the allotted time. If you record the time of leaving as the time taken to pass through the exit. I vacated the bay within the allotted time. This means you have suffered no loss of revenue to that bay (i.e to yourselves).
template letters on the cab website - follow link in earlier reply. but this is what CAB say
If you get a ticket
If you get a ticket on your windscreen or through the post, and you think that it is unfair because, for example:-
you didn't break the rules
it wasn't obvious what the rules were, either because the wording on a sign wasn't clear or there were no clear and prominent signs about the car parking rules, particularly at the entrance to the car park
the charge you are being asked to pay is too high. Legally, the amount charged has to relate to a calculation of the loss to the landowner. They can claim for lost income if you occupy a space that someone else could have paid for and used, but only if the car park was full and there were no parking spaces left. For example, if parking cost £1 an hour and you have been issued with a parking charge notice for £30, you would need to have parked there for 30 hours to justify the charge. If you challenge the ticket because the amount charged seems too high, you can also ask for a breakdown of how the landowner’s losses were calculated
the ticket has been sent to you as the registered keeper of the car, but you were not the person who parked the car at the time the ticket was issued
you had a good reason for breaking the rules, for example you may have stayed over the time you paid for in a hospital car park because your appointment overran
Yeah some are chancers, DEAL sound like that, some will push things all the way through to court.chancers..complete
Parking eye for instance. Ignore them at your peril.
Im not going to ignore. Imagine I bin everything and miss a county court letter?
keep a beady eye on this court case going through the system right now http://www.bbc.co.uk/news/uk-england-essex-31602876

I've used these people in the past when I forgot to push the button for a free ticket at the local retail park. £16 and they guarantee to get you off, or they'll pay the full cost.
Got a letter from UKPC about a month after filling in the form saying they were dropping everything and apologised for the inconvenience.
I personally suspect that the whole thing is actually run by the parking companies themselves, but it worked for me.
£16 and they guarantee to get you off,
A stamp, piece of paper and an envelope will get you off for significantly less via POPLA
Appeal it.
They deny.
Re-appeal, they give you POPLA appeal code.
You appeal to POPLA with "not genuine pre-estimate of loss", "is penalty which is unlawful under contract law" (contract law that governs your accepting their terms by parking), "they are not the landowner & therefore no loss suffered" (any costs they have incurred are normal business operating costs), & "terms of planning permission most likely prohibit xx from operating a business from xx site".
POPLA send letter finding in your favour & instructing xx to cancel ticket.
Is supposed to be how it works.
Parking Eye Scum took me to court, but lost my nerve & paid up.
Some rsole of a circuit judge had heard a test case & threw out all the arguments above, finding in Parking Eyes favour, & (at the time), idle rsed local magistrates were using this case as a precedent & finding in favour of PE.
To be fair to PE, the car park is perfectly sign posted.
It was the amount I disagreed with. I'd have happily paid £20, but £75 for a few mins overstay was just taking the mick.
Waiting on that High Court case now, & I'll be first in line to turn the tables on them with a Small Claims case if they are found against.
You could repair 2 small dents on a C1 for that
Or buy nice carbon bars
Or take you out for pie n peas and and a lot of booze
A stamp, piece of paper and an envelope will get you off for significantly less via POPLA
Depends how much your time's worth, I suppose.
Oh I will go all the way to court. I've just found the window/parking receipt so I'll keep that back incase I need to produce it as more evidence later on. Pity I've already sent the letter (recorded) otherwise I would have included it.
from earlier. the coop car park is never full!! and even if it was the footfall through the place would be such that you would be extremely unlucky to find it full i.e. constant stream of cars in and out. And the cameras haven't reappeared so how they expecting to enforce it?Legally, the amount charged has to relate to a calculation of the loss to the landowner. They can claim for lost income if you occupy a space that someone else could have paid for and used, but only if the car park was full and there were no parking spaces left. For example, if parking cost £1 an hour and you have been issued with a parking charge notice for £30, you would need to have parked there for 30 hours to justify the charge
That pics two years old. In pay and display carparks you don't muck about as I know thats your angle 😉Is this your car?
I think they work on the basis that people will be intimidated and or have a concern about their future credit record.
I had one last year for stopping at some services in the midlands for a meeting. I had lunch etc but overstayed the 2hrs.
I received lot of letters and responded explaining that their charges for the additional few minutes were disproportionate etc.
They stopped eventually.

I've successfully used this company in the past but they've wound up the business now - if you do a bit of googling there were some shenanigans going on with private parking companies and loads of allegations from both sides. I lost interest before I got to the bottom of what happened, but believe some people lost money?? There are other similar companies out there who seem to be legit and are recommended on forums about parking ticket stuff!
Still no response.
Still nothing although I suspect any post would come on a Saturday (as did mrchrispy's from euro carparks).
