So, it looks like Mrs Mcavennie's employer messed up her income tax contributions when she began her job back in 2007/8. We got a letter from HM Revenue & Customs looking for £800. Quite inconvenient really as we have just had a baby and she is on statutory maternity pay, so we are skint for the foreseeable.
Does anyone know if we have a leg to stand on against HMRC or her employer?
You should be able to get it rolled into her next tax code to avoid havig to pay the lump sum. If HMRC are being unreasonable about that her employer might make the gesture of loaning her the money over 6 months or a year, to save you forking out a lump sum for their error.
Sorry cant help on this but we are in same boat. There are some prewritten letter can adapt to self and send to them but so far are ignorant gits and choosing to ignore.
In theory the can only go back 2 years I think but even when my wife rang about hers were arses and of no use, despite like your wife it being down to employer error as she had given payroll all correct info and foolishly assumed those clowns did their job properly.
Just checked, template letter is here www.litrg.org.uk
Hope you have more luck than us, seems these muppets are untouchable despite it being an error from their end!
BTW if any consolation they are looking for 4.6k for 3 years from my wife.
Cheers guys. Yeah, HMRC plan to take the money over this coming tax year - but that still works out around £60 per month, which we can ill afford on statutory maternity, so she'll have to go back to work earlier than planned.
northshoreniall - thanks, I'll check that link out. Good luck with that whopping tax bill as well!
