how do i go about issuing a refund when the person has still got my item?

Only refund though Paypal back to the same account once you have the goods back

edit: sorry not helpful but i was immediately reminded of it. You say very clearly please return the item for a refund, via ebay message system. then if it gets escalated they can see you are behaving properly and ebay will wait for item to be returned rather than intervening.

be careful of requests to refund outside of Paypal or to a different account

And make sure you do it via ebay website itself, not clicking any links from emails sent to you that pretend they're from ebay.

bizarrely since i set up a ebay dispute and contacted the help desk she has gone quiet

If a buyer makes any complaint just offer them a full refund straight away. Often you will get the "partial refund" B******s - just give them their money back, claim the ebay fees back and then readvertise.

Yeh you wait until the item is returned before using the refund option in Paypal. (Don't make a new payment to them, refund the original)

Remind them that it is their responsibility to get the item back to you safely so they should use an appropriate postal service (with proof of delivery and insurance if its valuable)
