Can I just check, ebay do side with the buyer don't they? Wanting to return a phone which has scratches on the screen and seller is now saying he'll fight it and he has photos proving it was fine before he sent it (he does also mention the photos he uploaded to ebay, but they're all with the phone switched on, which makes it almost impossible to see the scratches in a photo - I know I tried - even though you can still see them with the naked eye).
My current phone isn't working properly and I'd like to buy another one now rather than having to wait for the dispute to go through (can afford the cashflow, but want to be sure I'm getting money back on this one).
Item not as expected, clearly.
Ebay will side with you as long as you are reasonable.
Anyone who says they will fight to the death rather than refund generally has something to hide.

Ebay generally side with the buyer, but not always. I've had a couple of instances where I [i]knew[/i] the buyer was a chancing ballbag and 'won' the dispute. It's still a monumental PITA though.
On the plus side, if they side with the seller, you can always sell it on as he has to you, knowing that eBay will side with you.
