So, this morning we had the pleasure of updating our wills with the solicitor and spending time talking about being dead 🙁

We also asked about sorting out power of attorney in case we are rendered incapable due to yet more unpleasantness - close family are having a nightmare sorting out a relatives finances after a massive stroke stopped just short of killing her, and they had nothing set up in advance.

The solicitor gave us an outline but said it was possible to set up and register a power of attorney yourself, which was much cheaper than getting her to plough through all the paperwork would be - anyone on here done it can give us any pointers?

You can do it online https://www.gov.uk/lasting-power-of-attorney for free.

The issue is probably who you get to do the certificate provision (Part B) it should really be someone who is familiar with the family and conversant with the 2005 Mental Capacity Act. This will normally be a solicitor or doctor who will charge for the privilege (my firm charges £50 plus VAT for each document and we are cheap).

The advantage of having someone advise on the process is that they will cover all of the necessary ground to assess capacity and therefore enable the certificate provision as a part of the advice process.

If yu have a look at www.lasting-powers.co.uk there is information that will help you decide what you need. If you want to use an advisor and are anywhere near Peterborough call the number on the site and I will talk you through how we can help.

Nick.
