Will shortly be getting the ball rolloroon my divorce, been living apart for over 5 years so should be straight forward. We have our own agreement for maintenance payments for the boy and no real hassles. Is it worth doing a financial agreement to protect and equity I have in my property (she used to live here) and things like my pension or are they not worth the paper they are written on as a solicitor led me to believe a few years ago?
Legal advice will always be yes. I’m in a similar position and I haven’t though, time will tell if I regret that.
Financial settlement , yes, the rest is pretty simple enough to DIY.
I paid a Solicitor, cost me around £750, the ex was being a right idiot, not replying to letters etc, so it took around 6 months.
Being in a right state at the time,I wasnt thinking properly, but afterwards, I would definitely have DIY, as there really wasnt any argument that we would be divorced, it would have been a case of present the papers, turn up to Court, see it passed.
As it happens, I did go to Court, expecting a 5 minute debate by the Magistrate/Judge, but all that happened was a list of around 10 couples names were read out, he asked if there were any objections, then said they have all satisfied the criteria, and the, IIRC, Decree Absolute would be passed.
Yeah I'm going down the DIY route just note sure if the financial bit is worth it or not. The only request for money was when she left which I agreed too, kept records of (somewhere) and that was that.
I got one done as part of the divorce 2 years ago. The ex is getting divorced again. She's now in a massive financial mess (both of them are) and Step Change haven't rulled out bankruptcy as the best option. Her solution seems to be start dating a wealthy man and ignore it.
So I could be testing how good this paperwork is :-O
