If I designed something based on an idea someone had and then they have had nothing whatsoever to do with it all , who owns the design ?

An idea isn't anything until something has been done with it.

I was about to say, apple tried to copyright the rectangle with rounded edges.

an idea someone had and then they have had nothing whatsoever to do with it

Well they had the idea that you capitalised on, so I'd say they had a lot to do with it 😉

OK what if you find out the idea already existed? And they were wanting to get into that market, but their improved version was ruubish and your version was better?

Have they got a patent on it or applied for one?

Have they got the resources to defend the patent.

Nah its existed for 20 years they thought they would reinvent it , but really it was a bit gash, then a mate of mine had a look at it added a shedload of stuff they never thought of and now are trying to claim the work as their own No brief no written agreement just a different version of a similar thing.
