Hi all,

I'm a long-term lurker, only registered at the beginning of this year in order to buy a frame from classifieds. Even though i'm still wet behind the ears, i'm here asking for help.

I'm planning to do my dissertation around victims rights, namely should they trump the accused's lack of intent, specifically focusing on causing death by dangerous driving.

I'm writing this to ask for some info, if you know of any cases of cyclists being killed as a result of driver negligence/recklessness then i'd like to know about them. Now i'm not asking anyone to do any research etc on my behalf, just if you remember reading of any such cases in the papers and can remember a name then i'll take it from there.

It shouldn't take much to find a lot of info re the Rhyl CC case. The Daily Post built up an extensive archive following it right through to trial.

If you're doing a dissertaion on this, then if you aren't a law student, I suggest you get to the Law Dept pronto. Ask the librarians there to help you learn how to search through cases and caselaw on this. If you are a law student, then you ought to be able to find this stuff anyway.

FWIW I think it's an interesting topic (as a lawyer), as intent, subjectivity and mens rea are often key requirements to various offences and other "wrongs". Were i to do a doctorate, it would be connected to this.

sources so far are very much appreciated, thanks chaps!

I am a law student, but one of the angles i'm approaching this from is an average person's view of "justice" a "law in action" type approach. Not every case on nexis etc will have had a lot of media interest so this is just one of the things i'm trying in order to filter information for that part of my diss.

Anthony was killed on an open section of road in good visability by a van driving into the back of him, the driver wasnt charged with any offence.

my friend was killed by a bus whilst riding his bike back in '96

He was cycling from work in London to his home in Greenwich

- - - when he was in a collision with a bus as he crossed

Waterloo Bridge. He was killed instantly.

I think the driver got off because of conflicting witness statements - the trial took place ages after the incident.

A teenager who killed a female cyclist when he lost control of his van in a Cumbrian town has been jailed for five years.

Matthew Lowther, 19, of McAllister Way, Dumfries, was found guilty of causing the death by dangerous driving of teacher Louise Stoddart, 42.

Ms Stoddart had been cycling with two other women at the time of the crash in Inglewood Road, Penrith, in June 2009.

If you get in contact with Zest, which is a women's health magazine they have recently had a campaign about women killed whilst cycling and in a recent magazine (maybe May issue) they had various case studies of women in London who had died, how it happened etc. They will probably help you out.
