Hi

I've successfully contested mis-issued private parking tickets before but I genuinely don't know if I've done something to warrant the one I received from the council yesterday!?

I parked where I have done for ages, on what appears to be private land alongside a derelict building. I made sure I wasn't on the road at all.

Getting to my car last night I noticed that Mrs RRR's car, alongside several others parked in the same area had tickets.

The ticket says "parking on a restricted road outside of permitted hours"
I wasn't on the road, perhaps I was blocking a pavement but shouldn't the tickets say that? Hive
Mind thoughts please?

If you have to cross a yellow line to park then it's an offence.

I made sure I wasn't on the road at all.

But you were on the road, just the bit of it that's commonly called the pavement. And blocked the pavement completely, meaning anyone in a wheelchair or with a pram has to go into the traffic to get past.

The sign says whatever the restricted hours are. Maybe I am just stupid but I didn't think it was a pavement as it's usually covered in cars :-/

Bencooper - you have a point about the pavement and I wouldn't have parked anywhere which would cause an obstruction but as silly as it sounds, this area is completely derelict with literally no one around, no business's or homes.

Tbh if the ticket had said 'obstructing pavement' then I'd understand it. I must admit I didn't think about the pavement until I got back to the car.

I believe the logic is that the yellow line enforces both the road in front of it and the area behind it. Assuming you're allowed to park like that at all, which is debatable, then the same restrictions apply as would on the road. I think.

The fact that you're parked about two feet from a sign which, presumably, is warning about unauthorised parking probably won't help your cause. (-:

You could have at least made an effort to park on the bit with the road entry 😉

Yellow lines apply to both sides of them - ie the road and the pavement.

My car fitted perfectly in the space (admittedly just touching the garage door) and I had been doing so for over a year and regularly saw traffic wardens checking cars in the restricted parking just up the road.

One day I came round the corner to see 3 council tow trucks taking away all the cars that were parked in front of the garages and a little old lady standing infront of the tow truck taking her little Metro away. Apparently someone with a pushchair complained they could not walk in front of the garages due to the cars parked on what we considered to be driveways. The council plans even showed that the little gravel area in front of each garage belonged to the property.

Cost me over £180 to get my car back. Consider yourself lucky as I would say you were obviously parking on the pavement and/or private land depending on the boundary.

Oof.

The real kicker with that is, the double yellows are probably there for your benefit to stop people blocking your garage.

Write to them asking if they know who you are. Tell them you're Ron Pickering, Internet Legend, and you'll settle it with bare knuckles and helmet camera.

EDIT don't worry if you're not Ron Pickering, apparently no-one knows who he is anyway.

you should come to Swindon, these people are happy parking on zig zag lines of traffic lines 'just nipping in the shop' 👿

All those with wheels on the footway are parked on the highway covered by the lines. The Citroen is committing a civil offence as it is parked on private land beyond the footway. The grey car in front of the Citroen is due a ticket.

Any traffic regulation order such as single or double yellow lines is enforceable from the centre of the highway to the back of the highway. A highway typically constitutes carriageway and doorway. Just because the marking are on the carriageway, they still apply to the footway.

Is there anything to indicate where the public highway meets private land?

Maybe ask to see the highway adoption records to see where the boundary is. Public might go back to the building line but it almost certainly does stop at the kerb edge.

If its council pavement, it looks a bit ropey. How about you trip on it, sue them and use the proceeds to pay your ticket!

perhaps next time park legally or cycle to your destination and dont block the footway to wheelchairs, and the disabled, obviously someone has complained or a new traffic enforcement officer on duty.

Yes it seems it is a pavement dunt it. Lesson learned although admittedly it didn't seem obvious at the time
