we bought a refurbished air fryer from the ebay branch of ninja (well i assume theyre affiliated, that may not be the case) last september.
started failing to cook evenly so we asked for a replacement which we got in february this year. this one has now developed the same fault, so wife asked for a refund. theyve refused as its not 'within 30 days of purchase'. theyve offered another replacement.
we'd now prefer a full refund and just buy a new one, but looks like we're not entitled to that, and they can just keep offering replacements, is that the case? i looked online at the consumer rights act and am looking specifically at this.....
so yes theyve offered a refund, but as the replacements failed, how do we ask for a reduction if its already been paid?
and that last bit, if they fail to repair within a reasonable time, rejecting for a full refund..... does that apply here?
my gut feeling is that they can just keep replacing and theres nothing further we can do, but just thought id ask the experts 😉

Similar issue here. Bought two Thermarest Mondo Kings at not cheap money. Not used it until last weekend, had it nearly 2 months. I'd checked one, but not the second. One way valve is two ways so makes blowing up tricky, not something you expect when paying good money.
I've had to send it back and they will repair the valve and send it back, but ideally I'd like a new one as it was un-used until last week, but I'd had it two months. Fortunately, the valve is an easy replacement, apparently.
I think the best you will get is replacements especially with refurbished items.
Your rights change depending on whether it's a retailer or a private sale.
Assuming the former then given the timescale you're right. You have to give them one opportunity to make good, which they've failed to do. 30 days be bollocksed, a fault inside the first 6 months is deemed legally to be inherent under the Consumer Rights Act and you're entitled to a full refund if they can't fix it. I've posted this on STW many times now, but I've had considerable mileage over the years from "just to be clear, can you put it in writing that you're refusing to honour my statutory rights?"
That said, if it's a private seller masquerading as a 'store' then you're likely shit out of luck.

That only applies to cars, or if it's goods outside of six months from receipt when the fault was first reported. A seller cannot make deductions following an unsuccessful repair/replacement within that time.

This...a retailer can't offer a faulty replacement for a faulty product and then just say "tough luck"...your origonal complaint still stands...
Where did you buy it from though? if it wasn't a uk retailer and it's 'grey market' etc, it's probably a hill you don't want to die on..

We've had two from ninja-kitchen. I think it is the official ninja outlet store. Both have been great and like new. One has been very heavily used and is still going strong. Other one is also fine, just rarely used.
Could you go for a different model instead, I think you have just been unlucky (but I understand wanting a refund)
@cougar comes through again, thank you. wife had a reply today stating that although ebay themselves cant refund it due to policy etc etc, head office will arrange a pick up and we'll get a refund as soon as its returned.
