Mother has bought a 3yr old car from reputable car dealer £7,000
Paid up front before collection.
Collected car Friday lunch all serviced and mot.
Sunday she decides to check spare wheel situation and the well is full of water and rusty.
Not a happy teddy bear, the parcel shelf is dry and can't see how and when this has come about.
Goes back to garage this morning and says she no longer wants the car as this may end up being a large problem.
They say they will fix but she is not interested.
Question - Ware does she stand regarding getting full refund.

Sounds like she's lost confidence based on one (minor?) issue.
I'm no consumer rights guru, but I'm pretty sure that the dealer will be able to make a "reasonable" attempt to put it right before having to offer a refund.
I think you can simply reject the car.. If that issue wasn't clearly pointed out then the sale was misrepresented.
I'd also be wondering, if it's got a new mot, hence the spare tyre would have been checked, how they failed to notice it was residing in a pool of rusty water. What else have they lied about?
I'd be pretty miffed personally!

Doesn't matter about credit card, you can reject it under the sale of goods act if bought from a business..

Cars don't have to have a spare. If it's there it has to be legal, but if it's not...
Or maybe the garage has a pet MOT tester?
If the wheel well is full of water and rusty then it sounds like the sealing was somehow compromised; sitting around waiting for the boot/rear end to be repaired etc...
How long has the dealer had the car? Phone the previous keeper to get some history
The point I was getting at is that they would have spotted the water and rust in the wheel well.. They would have had to inspect the spare as part of the MOT.. If a spare is present, it has to be checked for roadworthyness.. To not mention it at all suggests the car at best hasn't had a proper pre sale inspection, and wasn't sold as advertised/as described.
There's no way the dealership could claim not to know about it, they just kept quiet.
The sale was misrepresented.

Take it back and insist on a refund or another car.
