[Closed] Consumer law experts - bought new telly today - can I take it back??

Just bought a new wee TV today at Comet. Got it home, set it up and it is too small. Couldn't decide between a 19" and 22" and went for the 19. Should've got the 22. Can I pack it up and take it back and swap for a 22 even though it has been opened?

Best about it is, when I opened it up it clearly had been opened already. I won't be able to get it back to the shop till Monday.

Thoughts??

Legally they don't have to exchange. Pray on their good nature and be nice to them and you might be lucky.

Dunno, but you should have gone for at least 40", although STW will soon tell you that anything bigger than a 32" will cause dogs to bite childrens faces, another Tsunami in Japan and the inevitable commencement of WW3.

Aw balls. Your thoughts are the same as mine Don S. I hardly ever watch telly hence I thought 19 was plenty big but I know Mrs DB will have other thoughts when she gets home.

I agree that tellies that are too big are a threat to civilisation as we know it, hence erring on the side of caution and going small!

You can change your mind under distance selling regs. In a shop, meh.

Talk to the shop and go "I'd like to spend more money," there's a chance that the salesdrone will see pound signs and give you an exchange.

Worth a try. Worst they can say is get stuffed and I'm no worse off. At least it was only £150 and not some £2k monster.

Bloody 'ell, what is it? You can get a nice little Samsung 22" in Curry's for £150 - thinking of getting one for my caravan

Before you even consider your statutory rights, check Comet's own return/exchange policy.

Pretty sure they will have an open box return policy (although perhaps with a small restocking fee if you want cash back) if you change your mind within a specified period.

Just don't tell them you've used it. Provided you've got all the packaging and it looks fine/works OK, just tell them you opened the box but once you saw it on your TV stand you realised you needed the bigger size.

Bought a telly recently and asked if I could bring it back if it wasn't suitable for a refund. Comet was the only retailer who said no and bought one from Tesco for that very reason.

You may be lucky if you buy the larger one from them, but they seemed quite adamant when I asked
