My SO hates mobiles, fair enough, but her employer wants her to be in touch,so has bought her one, also fair enough. But they are insisting that she answers it at all times even well out of her working hours. Can anyone point me in the direction of the legal situation to this as i cant seem to get an answer from google!
She is just the manager of a community centre by the way not a spook or anything high flying!
You don't get reception on the company network at your house do you? My phone doesn't ;o)
You probably need to determine whether the employer is asking her to be 'on call'. If so, she should probably be paid a premium to reflect this increased availability and have the change written into her terms so that expectations are clear.
Otherwise, my view is that the employer is making an unreasonable request.
If she doesn't want to answer it - don't
There's unlikely to be any specific legislation it's a matter of what she's contracted to do & what she's prepared to do
i wouldn't imagine there's a legal requirement that you are or aren't obliged to answer your phone out of office hours as it would be individually negotiated. it's the sort of thing where one would have to be firm and stand one's ground in politely declining.
Thanks for the replies, we do happen to have poor coverage as it is, so thats handy, i think she needs to get it out in the open and state when her phone will be on and when it wont so everyone knows, but her boss is a little unpredictable to say the least!

As has been mentioned above. My company mobile is only ever switched on during my working hours. I know some people frown on this and believe that by giving people a mobile phone or PDA is a 'free' way or getting extra work from them but you have to get away from work you know !!!
If they want her on call then they should pay her for the previlage.
Same as Biffer as soon as I finish work I turn my mobile off. They have moaned a couple of times but there's bugger all they can do about it.
