If you were taking that CBD oil that's available over the counter from, well anywhere now, and you were subject to testing, would you fail? What's the compound(s) that are being checked for in these tests? Likely scenarios are at work, (although I think you have to act like you are actually gangsa trippin to be collared) or a police traffic stop.

I think they test for THC. One of the other cannabinoids of the plant. Although I imagine there could be trace amounts of THC in CBD products. I don't know. Also, I imagine that, given the puritanical, almost spiteful nature of drugs testing that the threshold is set so low that you'd fail just by looking at a packet of rizla in the past fortnight so...

On the other hand, mythbusters looked into if poppy seed muffins could cause you to fail a drugs test, and found it did, so drop the cbd nonsense and get some proper painkillers in your veins, and when you fail the drugs test just tell them you have been snacking on poppy seed muffins.
THC is the psycho-active compound that the testing process look at. The cut-off value will be agreed between the laboratory or point of care test provider and the organisation. The employer should then give information about their testing in their drug & Alcohol policy. In the case of the police that value/testing process may be in the public domain / enshrined in law. That cut-off sensitivity determines then if you're "positive" or "negative".
CBD oils are largely unregulated, no medicines and therefore THC levels are unknown. They mostly claim not to contain THC and it would have to be proven that a certain level was present for them then to be prosecuted for supplying a controlled substance.
But......I know of some research by a UK toxicology lab that showed that trace or >trace levels of THC were present in quite a few high street products....possibly not enough to cause psychoactive effects but possibly enough to trigger a "positive" test result against a low/sensitive cut-off.

Panorama or Watchdog did a study on the THC content and alot of the imported Chinese stuff contained more than trace amounts
Iirc the conclusion was same as yours, buy unregulated cbd and potential drug driving or operating machinery whilst stoned is entirely possible
This was something I was wondering myself a few weeks back. What I did was get a broad spectrum cbd oil which means there is supposed to be zero thc. But as said previously the cbd industry is highly unregulated and therefore you cant trust there is only trace amounts. What I have done was check lab reports and make sure they are done independently. There is many companies that do this, I will not name them as I don't want to advertise any one particular company. You can then check the validity of the lab test by simply calling the company it was done by. There should be an identity code for each lab test so it can be identified. I hope this helps.

Not really an excuse. A good policy and process (usually in safety critical industries/roles) will clearly state that you have to disclose taking of any substance that may cause a positive test result to the sampling officer. Most employers will then also have a contract stipulation that employees have to disclose outside of any drug testing process, to HR if they are taking a substance that may cause issues in their role even if it’s a prescription or over the counter medicine.
So non disclosure followed by a failed test would then result in a HR process (may not be sacking if the employer wants to support an employee with an abuse problem)
As an aside, I used to do routine drug screens for safety critical industry. One lunch time decided to test the poppy seed positive test theory - has 2 poppy seed adorned rolls for lunch then later had a positive indication on the urine screening.
