I made a claim on my insurance (very reluctantly) after I was run off the road in my 3 series. It was on moorland and late at night. A land rover (or similar) was on the wrong side of the road and I swerved to avoid him but hit a 3 foot, 45 degree grass bank at 30ish miles an hour.
I took it to my local tyres fitters who I use as they have a Hunter tracking machine. Nearside was over -3 degrees and offside was over -2 degrees. Normally, the car was setup with just over a -1 degrees both sides. Thats when I said 'B*ll*cks'.
I made an insurance claim and it was taken to a local large repairers but has never been right. They replaced all of the nearside parts for new - shock, topmount, steering knuckle, wheel bearing, droplink and bolts. The new parts made it better, but it still has a degree of bias. About -1.20 on the nearside and -0.10 on the offside. Ive taken it back once and soon to be a second time as it keeps pulling to the right. Sooner or later they are going to say there is nothing more they can do and try and wash their hands of it.
Does anyone know where I legally stand with it? I dont know if they have charged my insurance company for the work yet. My worry is something on the chassis is twisted and they wont be willing to get it jigged to sort it properly. I have a basic understanding of the various things but Ive just learnt from the internet rather than getting my hands dirty.
Depends on whether the insurance company feels it has made a "full and final payment". Generally when they pay out on a claim it's full and final. What you don't say is whether you submitted the repair estimates and what the insurer said in response by letter. I had someone rear-end me, insurer paid out and then 6 months later I discovered the exhaust had been cracked almost certainly by the impact, as company had already paid out I had to cover the cost of the new exhaust.
I didnt get a repair estimate, they gave me a copy of the report for what they replaced but when I paid the excess I signed to say Id paid for the excess. They gave me a vehicle collection note which hasnt been signed however. I have not talked to the insurance company at at all but may ring them.
The claim was off my own insurance. The other vehicle didnt stop and I didnt get their registration number.
