I'm posting this on behalf of a mate, who is a salesman for a company selling disability products. The company are in the shit financially and they took on a new director last year who has one by one picked off most of the workforce. He seems to have now turned his attention to my mate. They called a meeting last week to tell everyone that things were tight and the company was re-financed, so it's obvious that theirs a financial motive here.
My mate drives every day down to Birmingham and south from North West, which is fairly normal in that industry, I did it myself for a while. They by rights should be incentivising him as he is bringing in by far the biggest income into the company, yet they are trying to get rid. He's been there 3 years and they have sent him another contract with ridiculous T's & C's.
Then, on Saturday, without warning THIS LETTER landed on his doorstep. He's not under any disciplinary or performance review and they are wiping £4K off his salary, THIS MONTH!
I think it's constructive dismissal personally, they're are obviously trying to get rid of him as the expense he incurs travelling is great. He can't afford to be shafted at the end of the month but luckily he has one job offer already and another due, so he's out of there but what can he do to protect his interests before he goes???
The way he's been treated is disgraceful and if it was me I'd want to shaft everything I can get from them, but he's not me, he just wants to ensure he can get his salary at the end of the month to feed his family.
