If a website does not ask you tick a T&C's button at any time during selection, login and ultimately purchase, then how does this affect any legality of T&C they have hidden away? (But not referred to during purchase)

Any T&C's for a UK based firm would have to comply with the sales of Goods Act and also the Distance Selling Regulations and if they do not then those to pieces of legislation take precedent.

As a consumer you cannot be asked to opt out of those and if the T&C's do then they would fall foul of the Unfair Contract Terms Act which specifically prohibits any such opt-outs.

With this in mind there is very little an online store could add to its T&C's that would lessen your protection as a consumer.

As above, but if the company is based 'offshore' there will probably be bugger all you can do

The supplier has promised to make good on this now, so I think it is a non issue.
