We need to have a new oil tank as the current one is failing.
Ideally we would like to move it to a new location. The new location would meet building regs for distance from the house, but would not meet it for distance from a boundary fence, and a wooden shed that I put up.
I have just spoken with my insurance company, and they would not give me a simple yes or no as to whether my house would still be insured
I am aware of the house resale implications, and to be quite frank we would just lower the value of the house by £2k at sale for the cost of putting right, or even move the bloody thing again...

If the cause of the claim was due to a change you made which was in violation of the Regs, then they are unlikely to pay out....
Otherwise, they might try but the Ombudsman would probably rule against them.
I expect it would be a problem if the tank leaked oil across the boundary.
I doubt it will be an issue if an internal pipe springs a leak.

Your only option to get an answer is to tell them you're moving it. They're either going to maintain cover as now, add an exception for damage resulting from tank being too close to boundary and shed, quote a higher premium or refuse cover. Maybe give you a choice?
alternatively, ask a different insurer. There are no fixed rules, it's down to what they think is a risk. Unless there's a blanket exclusion such as "we will not cover anything which results from failure to comply with applicable law".
The distances are for fire protection so as long as it is 30 min fire protected then it’s still compliant. This can be by using fire board or a fireproof tank.
As long as you have 30cm around the tank to the fire protection then it’s still compliant. If you get it installed by an OFTEC company they sign it off as compliant so no issues for you and your insurance as any issues around non compliance would fall to them.

Thats the route we are now looking at going down. However people appear to want to rip us off to do that piece of work. ie £1k to install the boarding, when I can buy the sheets myself for approx £100.
