[Closed] Boundary Fence height question

My neighbour's garden is about 3' higher than mine with a retaining wall holding it all back. On top of that wall is a 3' fence.

On my side is a somewhat tatty beech hedge that my neighbour is in the habit of cutting off at the height of the top of his fence. Short of falling out with him he's not likely to stop (long story as I have asked that we let it grow but he's a stroppy old git).

If it comes to falling out I'd happily get rid of the hedge and put a fence up instead (or a lelandii hedge instead). Now, I know I can put up a 2m fence without planning consent ... but measured from whose ground height?

So, planning guidance please (I can do without neighbour relations advice).

Never mind the hieght of a new fence , it's an offence (no pun intended ) to cut a neighbours hendge etc unless it is overhanging their garden . Mate of mine had the same problem , the polis came round and had words with his neighbour , no problems since .

I can see many ways to fall out with my neighbour over this! I'm just interested in finding out the legal position, and whether I'd need planning consent to erect a fence that measures 2m from my neighbour's high side of the boundary or not.

If you want to build totally on your side and not across the boundary then it'll be the ground on your side. If the ground is higher on his side I suspect you'd get planning so it might be worth the extra cost to apply. Hedges can be as tall you like AIUI.

Interesting - does the 2m limit apply to fences between 2 houses (back door to back door)? We have a 4 foot fence with trellis on top at the moment. I've already fallen out with the neighbour (she made false accusations about us to the police and RSPCA and repeated them to our neighbours). I'd like nothing more than to build a Berlin Wall between us but would settle for a 6 foot fence.

1m if it fronts a highway, 2m everywhere else AIUI. Sometimes permitted development rights are removed and the rules are different in conservation areas or with listed buildings so it's best to check with the council
