Please help with some advice - Is there anything we can do to try and perhaps involve a tribunal?

So the better half been fired this afternoon as she has be 'underperforming'. Mid January she was put on a 3 month scheme to try and get her back on target. At the end of Jan she was up on the set targets in Feb she was well down but has lots of new business in the pipeline, 5th of March she is fired for not meeting targets....

For me mid Jan to early march doesn't equate to 3 months, also there appears to be no consultation and from her line manager she has had praise and talking about what the new year will bring (April onwards). Then out of the blue they take everything off her and turf her out the building.

We will be taking some legal advice, but is this worthwhile?

Any advice really appreciated -

How long is her service? Under a year then its very difficult to get any recourse.

Sounds to me like the employer has done what they need to - what does her contract say? Did they follow procedure? Put in an internal appeal

Pay in lieu of notice and stuff? I would say go to your union but of course she never joined one did she.

Law centre or CAB - but dont get your hopes up

She didnt meet targets as did the company probably so theyre looking for people to sack, and a lot of other companies are doing the same, its called recessionary presure, and if shes got less than a years service , shes got little hope.
The unions are now just about usless, as theres so many pepole loosing there jobs, and theyre unlikely to support one person , when they cant support bigger job loses.

we dont care about the numbers we fight and represent any member ...even when they are in the wrong. We cannot force employers to keep employing people though can we?
1. check contract and terms of it.. have they followed them
2. check the written scheme that was given in Jan this should follow their procedures and should include support and training where necessary. was this followed to the letter?

If they have adhered to all of that then there is probably little that can be done
The 12 month rule does not apply if gender is an issue were any male employees in the same position and not sacked ?

There are a few helpful sections on the Citizens Advice website:

http://www.adviceguide.org.uk/index/life/employment/dismissal.htm

ACAS will also have some useful information.
