I really want a beehive(not the hair) but can you have one in a small garden with a small dog?

If you get bees you need to get public liability insurance though this is pretty easily sorted by joining your local bee keeping association. If you're really interested I'd highly recommend having a look at the Haynes beekeeping manual, either buy a copy (as it will come in handy) or get one from your local library.
I know some people do get away with bees in their gardens but these are usually experienced keepers who know how to position the hives, protect them from the weather, etc...
Join your nearest club. They will give you invaluable training. Spend a year tending the club hives before you get your own. Get your colony (of bees) from the club (don't buy bees over the web that you don't know their history and disease history). If you do all this, you'll be fine.
You can keep bees virtually anywhere, in a wide open space or in a screened/walled area so they don't fly into people at head height.
