Apple won't be that bothered (or that's what they'll have us believe) as there's a lot of in-fighting over who's broken who's patents and Apple have just patented the way touch screen phones are unlocked. What impact this will have on current goings on is anyone's guess, one thing is for sure: I don't give two shites.
Regarding the patent thing - do Apple (or Samsung etc.) hold any international patents for smartphone stuff, or these just US ones? US patents appear to be just something you buy as a mechanism for enabling lawsuits, rather different to how they work in the rest of the world. I'm sure there is some good work patented in the US, but having a US patent is rather devalued IMHO.

Samsung sell a variety of smartphone models which run Android, and WinMob as well, I think so those sales are spread across multiple handsets. Anyway, it's not market share that counts, but profit, and Apple are currently neck and neck with Samsung.
