Everyone loves a middle aged established member of staff being shafted so...
New manager appointed and of 3 senior managers (similar roles) in the department he’s promoted one to be the manager of the department. The senior managers will now not be on the management team so there is effectively a demotion, sa reduction in status, impact and influence in the company. However the salary package stays the same. The demoted managers were phoned with the news after the decision was made. The position was not advertised.
So whilst not ethical has the new manager done anything wrong? I said this tantamount to constructive dismissal?

If it hasn't resulted in any redundancies or dismissals then businesses are free to change their organisation as they see fit. It's certainly not a constructive dismissal as they haven't forced anyone out of the job, particularly as they're still being paid the same - they're still within their rights to actually reduce salaries / de-scope roles if they can demonstrate a compelling business reason to do so, but they have to give adequate formal notice etc. Might be worth checking the ACAS website as they'll cover this kind of thing.
its not an issue at all. Its certainly not constructive dismissal or anywhere near it. Businesses can restructure how they like. Salary not affected? Non issue
So, the reduction in seniority of the position is irrelevant? How about the way it was done, shouldn’t there be some sort of consultation?

Ha ha, we’ll yes but that depends how ambitious you are. It also looks a bit rubbish on the cv too.
If your ambitious then leave, that is how things go some days. Chances of a promotion now are slim I guess unless the guy promoted screws up. It gives you an ideal opportunity to say why you want to move.

Any 'senior' manager worth his salt would know how to spin that.
If I was in your position, I'd be asking myself why this has happened and what I need to change about my performance.

Why do you need trickery? Has your job title changed? Your CV is a reflection of what you have done, if on that you are not getting an interview then that needs work. What you do in the interview is then what counts.

I'm not tying to be a dick, or kick you when you are down, but the head honcho must have had a reason to promote his friend and reduce your remit. I'm probably too paranoid about these things, but a bit of concentrated reflection to understand why it's happened will at least put you in stronger position to see any next moves coming.

It’s a restructure as TJ says it is pretty much a free pass, even more so when you still have a job and being paid the same. Internally they don’t have to advertise the position as it’s restructure, best man wins.
Just a re-org where peoples positions change. Happens all the time. The only damage is to ego and not sure there are any employments laws around ego.
similar happened to me in the past. effectively moved sideways, from a big team of 50 to 7. no change in pay or apparently role title or profile though it became pretty clear it was a very different job with only some elements the same.

I too was very angry, seriously considered a grievance but came to the conclusion this would just burn bridges and cause further unnecessary stress.
make the best of what you have or spend your energy finding the next role rather than going over what has been done to you
Is this public sector? Seems a lot of managers with overlapping responsibilities for private sector... I can see why the OP is pissed off and I certainly wouldn't be happy if a promotion prospect role wasn't advertised. But can't see you have much grounds for any official grievance and would likely just make your new role of being a senior manager that doesn't actually manage even worse. I'd start to look elsewhere, surely even if it's public sector it's only a matter of time before your new role is made redundant anyway?
There may be a problem down the line if things start to get tough financially for the company. You will be on a higher salary than others doing the same role, and that is a key factor when HR decide who to 'cull'.
