A guy i know a very little bit, but not a huge fan of for a few reasons, is currenty on incapacity benefit and has been for around 20 years. Can't work but can play golf 2x a week and use the gym a lot as well. Discovered today he also supplements his incapacity with downloadong computer games and films etc and selling them.

This to me seems a little wrong, but also very very difficult to prove. I would assume the latter would have an effect on the benefit but also is the latter illegal and anyway of proving it.

just wondering thats all

I'm just going to play devils advocate here..
but maybe his condition doesn't effect his golf... or perhaps the golf helps alleviate his condition..?

Maybe the gym falls under the same explaination..

Maybe he was injured (physically or emotionally or mentally) in the Falklands or similar and has had to manage for the last 20 miserable years on the minimal payout and lifestyle that incapacity benefit affords it's recipients.. embarrassed and paranoid that folk around him will suspect he's a bad egg.. maybe he simply has a legitimate claim that this country has made him sick and tired..
Maybe he makes a fiver or a tenner here or there helping out friends and family with xmas presents.. I don't condone it but I can see why people do it..

On the other hand... maybe he is a wrong-un.. maybe he's laughing at you as he entertains exotic ladies of the night at his lavish cocaine and champers parties.. maybe he summers at his villa in cancun on his ill-gotten gains.. maybe he's chuckling all the way to the bank on his £80 per week..

just a thought like..
can't you spare a thought for tiny tim at xmas good sir..?

Maybe you should be more worried about the super rich tax evaders than shopping mr small for a few quid?

yunki fair point, but not a war veteran this i know. however the several 42 inch plus telly's, regular weekends away , and the cruise once a year would probably mean more than the odd fiver here and there for pressies. i suspect he has significantly more income than 80 a week.

Now if people could stop and think long enough to see the good sense in the wise words of djglover the world would be a much better place..

I'm just trying to keep the spirit of goodwill to all men alive at this festive time of year 😉

As above you can't assume that his incapacity is a physical one - he might be mad as a box of frog

on the other hand - it could be the other way around supplimenting films and games sales with benefits. One of the reasons some people fraudulantly claim benefits if for tax reasons if you have an illegal income. If you make your money from the blackmarket (drugs, counterfitting, prostitution) then you don't have a relationship with the tax man. But you can't just not pay tax as not having any declared income would set alarm bells ringing. So you need to claim benefits to mask your blackmarket income.

You can earn a small amount on incapacity when I was on it, it was £5 a week. Which at the time was equivalent to 40 minutes paid work at minimum wage. I sold my own artwork and made a few hundred quid a week. However I am honest and was off work for a reason so I declared every penny to the DWP who were very supportive and helpful. I paid back any entitlement I had. They since helped me set up my own business. I would be careful before you contact them and see why he is off work. Selling pirate DVDs is a different matter in itself.

some interesting points, i never mentioned shopping him, but i am interested to know the legality behind what is going on. I know its not a tax avoidance were not talking driving round in a flash car massive house etc. it just narks me that u can play golf or go to the gym, claiming not being able to work, while others have to work, then making extra on the side illegally ( i assume) selling downloads.

I believe he is allowed to do a certain amount of paid work while on incapacity benefit, up to 20 hours a week IIRC. So maybe he can justify his illegal software/film enterprises as "permissible" work.

There are several levels of incapacity benefit, some are means tested, some are not and based on your ability to work and your previous National Insurance contributions.

These threads pop up regularly. They get the usual polarised views of "shop the cheats", to, "hes not really harming anyone is he?". None of the OPs ever actually come back onto the thread and explain what action they did or didn't take. So I can't really be faffed commenting.......maybe you should do what YOU think is RIGHT.

No harm in informing the DWP.
If he's nothing to hide then whats he got to worry about?

On the other one yes, its illegal, but how much does he charge? 😀

ok - more interested in the illegal download and selling is there anyway to prove it, or rather worry someone enough with how it can be proved. the incapacity thing just narks me. Basically he has been a **** (on and off) to a good friend of mine for a number of years so knowing the correct info on what he is doing mat prove useful in the future if he starts to be a **** again. this is where i know very little, eg will his ISP have a record of all downloadsm is there a specific brak fo the law dealing with this area of fraud.......

I know of a few people on incapacity who used to attend the same gym I was at. Some for depression, others had physical complaints and did exercises for those reasons. As far as I know currently no one but The registred disabled get free gym membership from DWP and exercise on prescription is for a limited time. It really is important to find out why he is out of work. As I said I was on income support and declared my earnings someone grassed me in, but as Iam honest I got nothing more than a but of humiliation.
