Another one for the e-bay gurus.
I just bought an item (specifically a tripod) which is missing a part that would have been sold with it had I bought it in a shop (set of spiked feet). I sent the seller a message saying that they are missing, and asking if they have them. So far no reply, but that was only yesterday. How long is it reasonable to give them? Also - if they reply saying "well, the listing never said anything about spare feet, so get lost" do they have a point? Or should the onus have been on them to state how this item differs from one bought in a shop?

Imo, a day isn't long. They won't be sitting by emails all day. Give it a few days.
As for inclusion in the listing, again imo, if it's not on the listing, chances are you're not getting it. Is it a 'standard' part of the tripod normally, in shops?
Yeah - would have preferred to go to a shop but this model is discontinued 🙁 It was being sold as an ex-display model, with the bag but not the box. This range of tripods are all sold with the extra feet. It's not the biggest of deals - I like the tripod and may never really need the feet, but it's an annoyance.
One full working day is reasonable for email response.
If the seller hasn't included parts that you feel are not there, didn't mention it and can't supply, raise 'Item not described' case.
You don't have to justify your position, the seller then has two choices offer a part refund or return for full refund.
part refund might work. I raised an issue - just a query - with a seller through Amazon and they were really quick to apologise and offer a part refund.
As far as I am concerned, I wouldn't expect to receive anything not specifically shown in the photographs or itemised in the description.
Do you have some kind of proof that they are part of the overall product? If not, you've had it imo (unless the seller is a nice person)
Yeah, standard for eBay is you're buying whatever is shown and described. Especially a product without a box, I wouldn't expect anything not specifically listed.
I don't think there's any point pursuing this through eBay if the seller doesn't have them.
TBH, buying an ex-display model - whether over the counter from a bricks and mortar shop or eBay - means there's a good chance that the item is likely to be missing some or all small parts, accessories, cables, manuals, etc. and should have been priced accordingly. The time to ask the question about what is included and what has been lost/misplaced/binned/scavenged for spares is before you pay, which gives you the opportunity to accept the deal, haggle, or walk away, and gives the seller the opportunity to either find replacements or knock a bit more off the price.
I vaguely remember that if its a proper shop selling on eBay they might have to abide by the distance selling rules, though I've not tested this out myself and may have imagined it.

IMO it would be a bit shitty to do that given the OP situation - they bought something, they got what was advertised and they don't really want the other bits they would have got if they had paid full price for an item listed as BNIB anyway.

each condition will have guidelines. IIRC anything "New" should (IMHO) be complete but "New - Other" may not not in retail packaging or other specified differences.
Just checked back and the listing says:
(name of seller) distribute photography and videography related accessories in the UK and Europe.
The items for sale through our eBay store are a mixture of end of line, current and new products that have been used for demonstration purposes. If an item has any packaging or accessory parts missing, this will clearly be shown in the eBay listing.
so that seems clear enough. I'll chase for a price reduction as I'm actually happy with the tripod !
