On the O2 website it says that any pay mothly customer can upgrade in the last month of their account. They then have this levels things where depending on how much you spend you are either a silver, gold or platinum customer.
Silver customers are allowed to upgrade one month early. So if my contract is due to exprie on the 1st of Feb as an ordinary customer I would be able to upgrade from the 1st Jan. I am however a silver customer allowing me to upgrade one month early which I would make the 1st of Dec.
Would you agree with that? O2 say that being allowed to upgrade onthe 1st jan is one month early but if you read their website it says any pay mothly customer can upgrade in the last month...
Silver is the lowest, so surely every Pay Monthly subscriber is Silver...which means that it's only 1mth early which they state.... which is the 1st Jan.

My phone only just works at the moment. Its an iphone but the home button is rather intermittent in its operation and seeing as you need to press that button everytime you use it it makes just using the phone difficult. So I need a new one either buying straigh out or upgrading etc but will have to wait until after xmas!
if the phone isnt working and you are on a contract - warranty it.

Apple only offer a 12 month warranty - you have to pay for more than that with Apple apparently because their stuff doesnt break. If I take it back to O2 they will send it off and could take a few weeks to get it repaired if they will repair it at all. So I may as well wait for the upgrade!

have you got a local apple shop? They sometimes do very cheap replacements for faults like that.
If you are provided with a handest as part of a contract, that develops a fault, the rest of the package is useless.
the phone warranty is a completely different thing to the length of contract. Most contracts state somewhere early in the bumf that the supply of the phone is incidental and not actually part of the mobile service contract.

Do not forget that your iPhone is also covered by your Statutory Rights under the Sales of Goods act and that can be more powerful than any warranty.Goods must be fit for purpose and must last for a reasonable time. As O2 sell the iPhone with an 18 month contract it is reasonable to deduce that they expect the iPhone to last at least for the duration of that contract

Oh, but if everyone is allowed to upgrade a month early then of course you can upgrade early as well.
O2 can send it off for repair but wont get back until Xmas when ill be due the upgrade anyway.

If they aren't doing anything special to keep you in this economic climate, then perhaps trying another service provider could be a way forwards.
It may be worth popping into an Apple Store if there's one handy, as they can make an instant decision. If your contract is up for renewal at the end of the year, then frankly it's just not worth the bother, although, having just thought about it, if you get it fixed, then get a new phone on upgrade, your old one can have a PAYG sim in as a backup, or you just use it as a Touch with the wifi. Mine is due for replacement next May. The new iPhone comes out in June, so the current one will be used with a PAYG sim as a backup and iPod.
This is why I'm pleased about the timing of my contract renewal, (copied from MacRumors a few minutes ago):
Toshiba announced (via 9to5Mac) that they have launched a 64 gigabyte (GB) embedded NAND flash memory module. The new chip offers 64GB on a single chip and will start mass production in the first quarter of 2010.The reason the largest iPhone (32GB) currently has 1/2 the memory of the largest iPod touch (64GB) is that the iPhone can only house a single NAND flash chip while the iPod touch can accommodate two. The additional space in the iPhone is taken up by its communication hardware. This new advancement should allow for 64GB iPhones and 128GB iPod touches in 2010.
Will they be over the £1000 mark then?
You may as well send it off and get it repaired for free...then at least you can sell it when you get your upgrade!
