Wonder if anyone on here can shed some light/opinions on this.
I have worked in my current job for nearly 10 years, in 2007 we re-signed contracts to go from 1 month to 3 month terms. Recently I resigned from the company, the job I am going to WILL wait until my three month notice period has expired, so I could just sit it out and wait. However, there will be nothing for me to do post handover (about one month) and I could do with getting cracking on my new job asap. Now, having reviewed my current contracts T&C's it would appear that my current employer has breached the terms. They took away a small payment (broadband allowance) in 2008, my contract states all changes to my terms of employment must be agreed by both parties in writing and this was not done. Does anyone know the legal standpoint on this? If the contract is breached by one party what is the process? Can I try to push my own terms (I am looking for a pragmatic month or so here not just leaving them in the lurch by walking out tomorrow), are they allowed to simply reverse the removal of the allowance and therefore state the contract is being honoured again? Trouble is our new Tech Director is a bit unstable, so don't want to rock the boat if I don't have a valid case.

As they broke the terms by withholding just put in letter that they did this so assume the contract is no longer valid and are thefore giving a statutory notice (could be one week) but with grace of 1 month. bob all they can do tbh they broke the cotract first
If you didn't complain about the 2008 change at the time you could be considered to have accepted the change.
you are on dodgy ground trying to show the contract was not valid. What sanction would they have if you just left after a month? Would they negotiate?
ask them if they are OK to leave after one month most employers allow this ...largely because leaving people have a tendency to be unmotivated and prone to both errors and illness

What do you want to happen? Do you simply want your employment (and pay) to end sooner - or do you still want the three months' notice pay?
